Rental Contract
This is a contract for short-term rental of Villa Verde Resort Dwelling, located at 3435
South Highway A1A, Melbourne Beach, FL 32951.

1. CHECK-IN TIME IS AFTER 4 P.M. EST AND CHECK-OUT IS 11 A.M. EST.

There will be no early check-in or late check-out unless previously agreed on by

management.

2. This is a NON SMOKING establishment. Violations of this rule will result in damage
fees. The Villa is an Eco Friendly resort and guests will be responsible for all damage,
beyond normal wear and tear, incurred to the Villa or its contents during their stay.
Guests will also be responsible if linens, kitchen supplies, or any other furnishings or
amenities are lost, stolen, or damaged, beyond normal wear and tear, during their stay.

**Our property is Green and we do not use toxic pesticides. Therefore, it is incumbent
that all guests ensure that no food is left out. Any food spilled on the floor by guests
must be picked up and disposed of immediately, dishes must be adequately rinsed, and
all leftover food particles flushed into the garbage disposals.

3. PAYMENT: In order to secure your reservation, 50% of the rental rate is due at the
time of booking, and the remaining balance is required 45 days prior to check-in.
Additionally, there will be a $500 temporary damage deposit posted to your credit card in
the form of a “hold.” This hold will automatically fall off a few days after departure,
providing this agreement is upheld.

Payments may be made by credit card (Visa or Master Card), wire transfer, or by
mailing a certified bank check or money order.

4. RESERVATION CANCELLATIONS:

A. FOR STAYS TOTALLING LESS THAN 1 MONTH: A forty-five (45) day

notice is required for cancellation. This requirement is a necessity, due to the
fact that a substantial amount of our clientele is international. For
cancellations that are made forty-five (45) days prior to the arrival date,
guests will receive a full refund, less a $100 administration fee.

For cancellations that are made less than forty-five (45) days prior to the
arrival date, management will make every effort to rebook the Villa. If we are
successfully able to fill the time frame you will receive a full refund, less a
$200 administration fee. In the case that we are not able to fill the space, all
of your initial payment can be applied towards a credit for your next stay at
Villa Verde. This credit will be good for up to one year from the date of your
original booking.

B. FOR STAYS OF 1 MONTH OR LONGER: A sixty (60) day notice is required

for cancellation. This requirement is a necessity, due to the fact that a substantial
amount of our clientele is international. For cancellations that are made sixty
(60) days prior to the arrival date, guests will receive a full refund, less a $100
administration fee.

For cancellations that are made less than sixty (60) days prior to the arrival date,
management will make every effort to rebook the Villa. If we are successfully
able to fill the time frame you will receive a full refund, less a $200 administration
fee. In the case that we are not able to fill the space, all of your initial payment
can be applied towards a credit for your next stay at Villa Verde. This credit will
be good for up to one year from the date of your original booking.

5. MAXIMUM OCCUPANCY: The maximum number of guests at Villa Verde is limited

to twelve (12); eight (8) persons on the first floor (main house) and four (4) persons in
the second story apartment, unless exceptions are agreed upon by management. This
will be determined on a case by case basis.

6. THIS PROPERTY REQUIRES A TWO (2) NIGHT MINIMUM STAY: A longer

minimum stay may be required during holiday periods. If a rental is required for less than
two days, the guest will be charged the two-night rate.

7. INCLUSIVE FEES: Rates include thorough cleaning prior to arrival, linen and towel
setup, all utilities, local phone service, cable TV, and internet. Guests at the Villa are
welcome to use the beach cruiser bicycles, beach chairs and loungers, beach toys,
umbrellas, and boogie boards, located in the garage, as well as the crib, stroller, and
large stainless steel outdoor gas grill.

8. RATE CHANGES: Rates subject to change without notice.

9. FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be

subject to forfeiture of advance payment deposit. Additionally, the party will not be
permitted to check-in.

10. WRITTEN EXCEPTIONS: Any exceptions to the above mentioned policies must be
approved in writing, in advance, by the management, and attached to this contract in the
form of a signed addendum.

11. HURRICANE OR STORM POLICY:

No refunds will be given unless:

a. The National Weather Service orders mandatory evacuations in a "Tropical

Storm/Hurricane Warning area"
b. A "mandatory evacuation order has been given for the Tropical
Storm/Hurricane Warning" area of residence of a vacationing guest. The day
that the National Weather Service orders a mandatory evacuation order in a
"Tropical Storm/Hurricane Warning," area, we will refund:

1. Any unused portion of rent from a guest currently registered

2. Any unused portion of rent from a guest that is scheduled to arrive,

and wants to shorten their stay, in order to come in after the Hurricane
Warning is lifted.
3. Any advance rent collected or deposited for a reservation which is
scheduled to arrive during a "Hurricane Warning" period.

12. The management reserves the right to refuse accommodations to any person(s), or
to immediately remove any guest who violates this agreement or engages in conduct
which is unlawful, disruptive, or endangers the health, safety or welfare of others. These
rules are established pursuant to Chapter 509, Florida Statute.

13. PARKING: No motor vehicles of any kind are permitted in the garage.
Please do not park on the lawn or along the side of the road.

14. BEACH ETIQUETTE:

A: As a courtesy to our guests, we have provided outdoor showers. Please

make an effort to rinse off all beach sand before entering the Villa. There are two
showers, one located on the north side of the property, and one on the
crossover.

B: Our dunes are the #1 nesting place for the endangered Loggerhead Sea
Turtle. Please help us protect the natural dune vegetation and wildlife by using
our private beach crossover as your ONLY method of accessing the beach.
Walking on the dunes or tampering with Sea Oats is illegal. Any damage to the
dunes or vegetation will result in a fine. All dunes and Sea Oats are protected
under Florida Statute 370.041.

15. We have hosted several weddings and large family reunions at the Villa, with guests
coming from all over the world. For some of the larger gatherings, it is necessary for the
potential clients to view the property. Guests at the Villa agree that, with 24 hours notice
from management, they will allow a 15 or 20 minute walk through by clients, under the
supervision of management.
