AN ORDINANCE ESTABLISHING THE BAGOLOD CITY ANTI.DRUG ABUSE


couNcll (CADAC) AND PROVIDING FUNDS THEREOF-
WHEREAS, it is a declared policy of the State to provide effective mechanisms
or measures to re-integrate into society individuals who have fallen victims to drug
abuse or dangerous drug dependence through sustainable program$ of treatment and
rehabilitation;

WHEREAS, Section 16 of the Local Government Code of 1991 provides that


Local Government Units shall pursue undertaking to improve public morals and
maintain peace and order among other equally significant concerns;

WHEREAS, pursuant to DILG Memorandum Circular No. 2009-09, an


emphasis as to the primary responsibilities of the local authorities in support of overall
government efforts to address illegal drugs and other substances was made;

WHEREAS, as required under Section 51 to 53 of RA 9165, otherwise known


as the Comprehensive Dangerous Drugs Act of 2A02, Local Chief Executives and
Sangguniang Members must ensure the mandatory inclusion of the Local Annual
euOget of a substantial appropriation that can adequately assist in or enhance the
enfoicement of RA 9165 giving priority to preventive or educational programs and the
rehabilitation or treatmerrt of drug dependence and cause the enactment of an
Ordinance complementing the Comprehensive Drugs Act of 2002 if none has yet been
passed, or to amend the same to be consistent with the provisions of the said Act, and
ensure the effective enforcement thereof.

WHEREAS, the damaging effects of illegal drugs to fami$ life, community


peace and harmony, the increasing use of illegal drugs has significantly contributed ts
the incidence of heinous crimes.

NOW THEREOFE, be it ordained by the Sangguniang Panlungsod of Bacolod


City in session assembled, that.

SECTION 1. TITLE:

This ordinance shall be known and cited as an Ordinance Institutionalizing the


Bacolod City Anti-Drug Abuse Council (CADAC)

SECTION 2. DEFINITION OF TERMS:

A. CADAC or Council - Bacolod City Anti-Drug Abuse Council


B. BADAC - Barangay Anti-Drug Abuse Council
c. DSSD - Department of social services and Development

SECTION 3. CADAC ComPosition.

The Bacolod City Anti-Drug Abuse Council shall be composed of the following:

SECTION 4. BADAC Composition.


The Barangay Anti-Drug Abuse Council shall be composed of the following:

SECTION 5. DUTIES AND FUNCTIONS.

The City Anti-Drug Abuse Councii (CADAC) shall have the followitrg duties and
functions.

1. The City Mayor, in his capacity as Chairman of CADA,C shall have the following
responsibilities:
a) Call on the local PNP, pursuant to his power of operational supervision
and control over the local Pt{P under Section 51 (a) of RA 6975 as
amended by Section 62 of RA 8551, to conduct periodic or
unannounced orrsite inspection of dens, resorts, bars, karaoke bars,
nightclubs, and other establishments or houses suspected of being
used as drug dens or piace of sale or delivery of illegal drugs.

b) Revoke the business permit of any business establishment found io be


the site of the deliveries, sale and use of illegal drugs and substances.

c) Prcvide support financial or otheruvise to the local PNP that is


necessary in its sustained operations against illegal drugs.

Serves as focal point through which various organizations and individuals work
togetl-rer cooperatively in the plannrng, implementation and evaluation of
programs on drug abuse prevention.

4. Provides for a mechanism to obtain funds, volunteers, facilities and technical


expertise, and

5. Performs other related responsibilities may be assigned by competent


authorities.

SECTION 6. DUTIES AND FUNCTIONS OF BARANGAY ANTI-DRUG


ABUSE COUNCIL.

1. The Punong Barangay as head of BADAC.

a) Shall identi{y drug affected house elusters, work places, streets, puroks
and sitios where the delivery, sale or use oi illegal drugs are being
conducted and to report the same immediately to the PNP or the
Philippine Drug Enforcer=rent Agency (PDEA)

bi Extend necessary assistance and cooperation, from operations up to


prosecutions of PDEA and PNP authorities in its operation against
illegal drugs.

2. Coordinates with CADAC all activities and programs the BADAC intends to
conduct within their respective Barangay Concerning drug education and
information dissemination.

3. Monitors, identifies, documents and reports tc CADAC all informatisn related to


illegal use and illegal drug activitres.

4. Performs such other duties and functions as the CADAC may direct.

SECTION 7, TERM OF OFFICE OF CADAC & BAtrAG MEMBERS.

Members of CADAC & BADAC, as the case may be, is co-terminus with
the appointing authority, in this case the City Mayor, Punong Barangay.

SECTION 8. $ECRETARIAT.

There shall be a City Anti-Drug Abuse Council (CADAC) Secretariat which


shall handle the administrative and technical actir,,ities of the CADAC. Specifically, the
Secretariat shall prepare plans and programs for the consideration of the Council;
supervise, direct and monitor for the council implementation of approved policies, plans
and programs, undertake the ccordination of activities with appropriate agencies of the
government and provide a forum for interdisciplinary dialogue and deliberation of major
issues and problems affecting anti-drug abuse problems.

The secretariat of the CADAC shall be headed by the City Social Welfare
Officer of the Department of Social Services and Development (DSSD) and shall be
assisted in its function and duties by two {2) Registered Social Workers, one (1) Clerk,
one ('1) Encoder. The two (2) Registered Social Workers are also in charge of the
"One-Stop Pracessing Desk" for the speeCy processing of documents for treatment

SECTION 9. MEETINGS.

The Council shall meet regularly at least once every month or as often as
may be necessary upon the call of the Chairperson.

SECTION 10. FUNDING.

The council shall be funded with an annual budget to be drawn from the
Five percent {5%) of the Twenty percent tzlYo} Development Fund of the Internal
Revenue allotment based on Sections 51-53 of RA 9165, otherwise known as the
Comprehensive Drugs Act of 2002 as to the mandatory inclusion in the Local Annual
Budget.

SECTION 11. EFFECTIVITY CLAUSE.

This ordinance takes effect immediately upon approval.
