Managing Performance, Conducting Workplace Investigations

Effectively Equips Professionals with the Ability to Recognize, Investigate and Report the Findings of Crucial
Workplace Investigations

Course Description:
This program has two key themes - getting the best out of your people through appropriate performance management to
ensure that employees' activities and outputs are congruent with the organisation's goals, and minimising the risk of successful
claims being made against your business when termination does occur.

This course covers the universal principles of excellent investigation; how to identify issues and then plan an investigation; how to
conduct thorough witness interviews even if the witness is hostile or difficult; how to deal with whistleblowers, how to gather,
organize and review physical, digital and documentary evidence; using the Internet as an investigative tool, how to assess
evidence and how to write clear and convincing reports. The course is designed to give anyone responsible for conducting,
supervising or reviewing investigations or fact-finding of any kind, the tools required to ensure that they are done objectively
and thoroughly. It covers the basics applicable to virtually every type of investigation, including:

WorkplaceVery good course. Great information, well presented.

Regulatory / Compliance
Healthcare
Audits
Inspections
Insurance
Health and Safety
Security/Loss Prevention
Human Rights/Ethics/Integrity
Administrative Fairness

The course includes discussions on the importance of ethics in planning and conducting investigations.Many different problems
can lead an employer to start an investigation, and not every investigation necessarily fits the popular profile of interrogations,
witnesses under harsh lights, and long, drawn-out detective work. Here are some common reasons why companies investigate
employees or situations:

Attitude problems
Substance abuse
Discrimination complaints
Harassment complaints
Threats against others
Vandalism and other sabotage
Violations of work rules
Safety problems
Theft
Fraud

Naturally, each type of problem demands its own methods of investigation. However, certain common threads run through
each type of investigation situation. The investigator must:

Be knowledgeable about relevant laws

Uphold the privacy rights of employees and others
Conduct a thorough investigation, but without letting it drag on too long
Be objective; and must keep his or her mind on the ultimate goal of any investigation, i.e., discovering the underlying
reasons for the problem so that management can take corrective action.

In essence, investigations are just a tool for management to use in analysing the reasons for problems or gathering data to
make management decisions.

Fact-finding in the workplace can be amongst the most complex and challenging of investigations. Using a real-life case study,
this segment will show how the lessons learned during the day apply in the workplace context. We will cover the 10 steps
necessary to ensure a workplace investigation can withstand scrutiny.
This Master Class will provide Professionals with the skills to:

Recognise when an investigation is in order;

Decide what the investigation should establish;
Select appropriate investigators;
Identify potential witnesses and documents for review;
Plan the investigation;
Design investigation interviews
Establish security for files and records;
Be prepared to modify and update the plan as needed based on new information.

The main goal of any investigation is to provide a sound, factual basis for decisions by management. The investigation should
also produce reliable documentation that can be used to support management actions. Finally, an investigation of
employees should reveal whether any misconduct has occurred and identify (or exonerate) specific employees who are
suspected or guilty of misconduct, and put a stop to further wrongful actions. We will also look at the Work Personality DNA of
a good Workplace Investigator and provide an opportunity for all attendees to undergo a Workplace Personality DNA.
