SYNOPSIS

My family and I are victims of predatory lending & mortgage fraud and deceptive practices

I need help, please help me.

A day before signing loan documents with Loan 1-2-3 in riverside I received a Call from Felicia Brown, I was informed that the
transaction was cancelled that she had over looked that my home was commercial zone.

I needed to refinance my home, my ex-husband wanted money to buy a home.

I was given the contact number for Paul Hayes. I contacted him explained my situation that I needed to get a second I needed
$60,000, payment around $750 but no higher than $800 ( advice from Felicia Brown) I asked Mr. Mike Navar send him a copy of
the appraisal report, Paul he call me back asked me for my personal Information, employment information, and income information
and said he would get back to me.

He called me back a few times, let me know how things were going, then he called to tell me that, I would be taking to Warren
Phillips, but if I had any problem or any questions I could call him.

Warren Phillips to give me an appointment for 1:pm on Monday August 21, 2006, he gave me a number to call if I needed
reschedule. I reschedule to August 22, 2006 with Warren Phillips, 1:pm at 6117 Reseda Blvd. # E, Reseda Ca. 91335. we were late
we got lost.

English is my second language I am native from Mexico came to this country at age 11. warren Phillips Run My credit he was aware
of my credit scores, my Income was fully disclosed, Warren Phillips, the agent had me sign the loan papers, later I learned the
papers I signed was to take a loan against my home , not to refinance my loan.

I was placed on a 5 years interest only balloon loan at a 10% interest with monthly payments of $1,326.67 a month not including
taxes nor insurance,  at the time of this transactions my income was $1629.

$ 539.00 of that was my Son SSI check $450 child support (not court mandated ) and $ 640 In home support Services.  Mr. Warren
Phillips placed me on a non affordable loan, based on the equity  of my home not on my ability to repay the loan setting me to fail
and eventually lose my home to foreclosure.

According to warren Phillips Calculations  the final payment of $161,000 due on 11/1/2011 this loan would of have cost me
$240,000, how in earth was I to pay this loan with a monthly income of $1,629 a month.

Warren Phillips fail to disclosures on this loan, I never would of taking this loan under any terms, not using my home as collateral.

Warren Phillips never had the intentions to refinance my loan, his intentions were to take my home and make a big profit on the
equity.

He gave me a predatory loan, removed me from title, title was recorded under different entities, title was recorded before he
deposited the funds in my bank account, Added documents to the loan, my signature was forged on some of the documents,

1.   I purchase this home on 5/1988. See Attachment #1 Grant Deed Dated May 17, 1988.

2. Prior to warren M. Phillips predatory lending practices and fraudulent actions the balance of my mortgage was $38,127.61 if
paid by 9/01/2006 or $38,319.20 if paid by 10/01/2006. See Attachment #2 Midland Mortgage Payoff Statements(2) Issued
dates: 8/03/2006 & 8/24/2006.

I wanted a to refinance and take $60,000 from the equity, On 8/2006  my home that was appraised at $362,000.

3. On 8/22/2006 My Ex-husband  and I signed what we were told a quitclaim deed. See Attachment # 3 Quitclaim Deed.

I was rushed to signed additional documents, the content of the documents was explained to me at all the terms of the loan was not
explained, the terms of the loan were not explained nor disclosed to me during this time I dint ask about the payment amount
because I was under the assumption that my payments were going to be no more than $800 per month, With my income of $1,700
( mi son's SSI, Child support, IHSS, part-time job) that was all I was able to afford.

4. I received a letter on September 11, 2006, the letter is dated 8-05-2006, enclosed were payment coupons and 2 long
documents, described by Warren Phillips as HUD-1A, I was to signed the HUD-1A and returned to warren Phillips. My monthly
payment was $1,326.67 per month, that was $500 over the amount I was told. I called Warren Phillips and told him there is a
miss take on the payment amount, I was told and I agree to a monthly payment of $750- $800. Warren said that I had 3 days to
cancel the loan transaction if I did not agree to the loan terms. He said I had no pre-payment penalty I could refinance out of this
loan as soon as next month. I was very upset I forgot to send warren Phillips the document. This HUD-1A was added to the loan
documents, I dint signed any long size documents at all on 8/22/2006.See Attachment # 4 First Apollo Home loan letter

5. Here are copies of some letters I was send by Warren Phillips, and letters I send him, supporting documents to Warren Phillips
abusive late, and additional fees on this account. See Attachment # 5 Letters 2007.

6. Warren Phillips gave me a non affordable loan with the intentions to foreclose on my property, he run my credit and was aware
of my credit scores and my income and gave me more money than requested. According to payment coupons received by mail my
new mortgage payment was $1,326.67 per month. during the time of this transaction my monthly income was $1,629. Warren
Phillips had no consideration of the hardships my family and I may suffered as a consequence of his immoral and deceptive practices
and actions. See Attachment # 6 Payment coupon. Please referred to Attachment # 5 for additional supporting
Information.

7. July of 2008, I found on the internet I found an agency that claim to help homeowners at risk of losing their homes. I Called
Inland Fair Housing and Mediation Board, located in Upland, California. I was asked to bring the loan documents, the truth and
lending note copy of the deed, payment coupons, all the loan documents. I was told I needed the documents by my appointment
day 7-9-2008. on July 3, 2008 I called warren Phillips office and talk to Carrie and made my request to her, I also Fax a request for
the documents to be Fax to Inland Fair Housing and Mediation Board. See Attachment # 7 copy of the fax send to Warrens
Office and requesting the documents (2 pgs) and copy of contract I signed for I.F. H. M. on July 9, 2008. My request
once again was ignored.

8. warren Phillips ignored every request for a copy of the loan documents, or he would reply with " a copy of the loan documents
was given to you, when you signed them" something lame like that until Mr. Gilbert Rivera wrote a letter and faxed it requesting
the loan documents. See Attachment # 8- request for loan Documents.

9. The next day I received the loan documents. After reviewing the loan documents, I was able to understand why Warren
Phillips rushed me to sign the documents, I was able to understand why Warren Phillips failed to disclosed the terms of the loan, I
was able to understand why Warren Phillips did not explain the content of the documents I was signing, he dint want to take a
chance of me refusing to take the loan under the actual terms also after reviewing the loan documents I found out that Warren
Phillips was the real Estate Broker, and loan originator, and the loan signing specialist, also PUBLIC NOTARY, the escrow agent and
servicing agent also the trustee and beneficiary for this loan transaction. See Attachment # 9 Loan documents please read
Warren Phillip's comment under HUD, A signature was requested but ........please See Attachment # 5 First Apollo home
Loan letter dated September 5th, 2006. as supporting evidence. Warren Phillips send me this document for me to sign and
returned, I just never did, I have the 2 original copies he send me. Under the circumstances Warren Phillips made a new HUD-1A
and made a false statement.

10. Warren Phillips is also the owner and president for Apollo Home Loans, Inc. A California Corporation Warren Phillips is also the
Owner and president for First Southern loan Servicing Inc. See Attachment # 10 Warren Phillips, First Apollo, Southern

11. Warren Phillips continued adding abusive late fees to my monthly payment. my requests for an explanation were ignored.
Letters notices of default an foreclosure were send to me almost every month, sometimes a few times a month. See Attachment #
11 3-3 to 7-9, 2008 Letters .

15. My family and I have gone without, I can only provide for my family was is very necessary trying to keep up with the
mortgage payment I juggle the utilities, I don't worried about a car payment nor insurance nor gas my car Got repo and I sold my
truck. Even when I was able to send 2 payments, made no difference because Warren Phillips would not giving me the proper
credit for such payments. Warren Phillips never provided me with an account payment record, tire of the late and additional fees
and Warren Phillips giving me no explanation I finally I made a request for a payment record for my account transactions. I was so
up-set after I reviewed the lame payment log Warren Phillips send me   See Attachment # 15 Payment Log By Warren Phillips

I have requested help from agencies that claim to assist distress home owners such myself, I even did the hope counseling 4 times,
a contacted advocated agencies Spring Board, also consumer union, money management, also many attorneys that claim they are
fighting for the consumers not true, I contacted an attorney that has a commercial in TV claiming to help in contingency bases, not
true. Some of this individuals just give false hope they are predators just like the lenders, their claims of helping homeowners are
false, all the ones I contacted asked for a retainer fee of $6,000 to $8,000 just to retain their services.

16. I contacted and made a complaint with Consumer Affairs, Attorney General, Federal Trade Commission, HUD, RESPA,
Department Of real Estate I also Contacted Jerry Lewis , Barbara Boxer to mention a few. I have correspondence from agencies I
have been in contact with. See Attachment # 16 contacts.

18. 10-2008 I received the notice of default Warren Phillips was asking for . See Attachment # 18 Notice of default.

20. 11-08 send warren Phillips several letters requesting for a loan modification to an affordable payment or to reduce the
interest to a 5%, for the remaining term of the loan. Please Refer to See Attachment # 14 10-01 to 12-08, 2008 letters

20a. 12-2008 I paid $1,000 for a Loan Audit, Warren Phillips, ignored the audit/violations found . See Attachment # 20a Loan

21. With the assistance of Colton Legal Clinic on 2/2009 I filed bankruptcy, I was determined to save my home, Warren Phillips was
determined to take my home. The trustee's sale was stopped due to the BK, but on march 18, 2009 the bankruptcy was dismissed,
the trustee advised me to hire an attorney and re-file. See Attachment # 21, 2-09 Warren Phillips Bankruptcy Fraud

21a. Warren Phillips, had no problem altering documents and present them to a higher COURT FEDERAL COURT not once but twice,

From the parking lot I called Advanced Reconvayence to asked if there was a new sale date for my home, Vicky said that the new
sale date was set for 4/1/2009. (this sale date was not recorded, nor did I received a notice).

22. Few days after I went to the Trustee's office in Riverside Ca. I was seen by an attorney and a supervisor. I had copies of the
documents that Warren Phillips altered, I also provided original copies from the San Bernardino County Recorder's Office. I was told
they would talk to the trustee regarding the mater. Warren Phillips did not only altered the documents, he continue adding abusive
fees. See Attachment # 22 Warren Phillips Altered Documents and deceptive practices. Please notice the property
and the annual interest is blank.

I felt as if my world was crumbling down on me, and no matter what I did to keep it together it was useless.  Warren Phillips was
determined to sell my home and he was determined to do whatever it was necessary to accomplish that, I file Bankruptcy by this
time Warren Phillips

On 4-1-2009 I file Bankruptcy again to stop the sale of my home

I wrote a letter to the Bankruptcy court Judge praying and hoping, I would get some Justice and send it but register mail I send
copies of the loan documents and explained myself the best that I could, the documents from the county recorder's Office, also
copies of all the agencies that I have request for their assistance, I also mention that sale of my home was not advertised on any
local  news paper, I also provided copies of the so many noticed of defaulted warren Phillips had send me, also letters were I request

an explanation of many additional fees and late charges, letters were I request for the interest rate be lower to an adorable rate,
documents were it shows all the abusive fees & charges by Mr. Warren Phillip, I was Ignored I never received anything back from
the Judge.

by the time I when to court for the bankruptcy I had to pay $700, to the trustee, plus the mortgage payment $1,326.67.  I Had read
that in bankruptcy an Individual could file an adversarial procedure against the lender, I asked Attorney wind ham about that and he
reply I don't due adversarial proceedings you would have to hired another attorney to do that. I made 1 payment to Warren Phillips
and 2 to the bankruptcy trustee and I was not able to make any more payments. my bankruptcy was dismissed I failed to make the
payments.

from all the stress I started to have problems were my heart would go so fast that my whole chest pounded, My kids would be just
as upset as me, my two 14 and my 9 year old would pray asking god not to take their mom home, My 14 year old (that was born
with spinal bifida) told me that if god would take me home, He would kill himself nobody else would take care of him.

of my home was schedule for October 2, 2009.

I found this attorney Charles R. Wear over the internet he has a web-advertisement, he advertised helping homeowners with civil
law suits my against their lenders for predatory lending and mortgage fraud. I contact his office in Riverside CA. I made an
appointment to see him. I  Was told that for a fee of $ 5,400 and 35% of any punitive damages awarded by the court he would
help he with the law suit he said due to my income, and taking into consideration all that my family and I been through I needed
$1,400 to retained his services making $1,000 monthly payments until paid in full. 

I could not come up with the money so my  24/22  year old sold their 1947 Plymouth for $1,500, on September 4, 2009, I retained
attorney Charles wear.

finally on 9/29/2009 I was asked to come and signed the civil complaint.

when I was at the attorneys office I was told that he called Warren Phillips to let him know a law suit was going to be filed against
him, and the other parties involved.

23. Attorney Charles Wear and Warren Phillips agreed that the sale would be postponed until 10/16/2009, to work a modification
agreement. . See Attachment # 23 Attorneys Draft.

the attorney did not showed me any letter Nor did I signed any documents. I was told by the attorney that their agreement was, if
we come up with a modification agreement you agree not to file a civil law suit against him nor his investors. 

I have lost everything that I HAVE EVER OWNED, I have spend money I dint even had and ( I borrow) many times I've barrowed
just to be able to feed my family. money that I'm paying back little by little, I'm still making payments for the Bankruptcy Attorney
fee of $4,440. My older kids sold their things they owned trying to make our mortgage payment and to save our home, we have
gone without for too long trying to save were my kids have been safe for the past 22 years. Warren Phillips is well aware of his
actions and did not want his investors nor him to be exposed for their actions.

Attorney Charles did not showed me any draft did I signed any documents that were going to be filed at the court, the attorney said
he would propose: monthly payment of $750 apply to the principal, pay the loan valance by 11/1/2011 for him to pay the back the
broker fees $8,000 also Attorney fee of $5,400.

I was very up-set, so the attorney said for me to go home and think about it.

I presented a loan mod proposition to the Attorney plain and simple, I mention the all the violations under the California civil
procedures also the tile and RESPA violations and I also mention the actions under the criminal law.  and I asked for a clear title of
my home and punitive damages.  the attorney said Now I understand what you want me to do, you want me to go ahead and file the
law suit.

for my luck on October 1, 2009 there was $345 of insufficient fees taking from my checking account,  on 10/4/2009 I called Attorney
Charles and asked if he would cash the post paned check in 10 days went I got paid . he terminated our contract because he said
that I had no intentions to pay him, but on an E-mail he states different and claims communication issue.

I requested a refund and my documents, I received my documents he refused to refund my money he stated that he put too much
work and time working on my case that I owed him money.

On 10/14/2009 I tried and faxes a loan modification proposal but for some odd reason Warren Phillips fax was not receiving any
faxes, so I walked to the home depot and tried to fax the proposal 3 time and I was told that the fax was not receiving any fax.

when I got home my 25 year old said that someone called 5 minutes before 5 and asked if someone was trying to fax something to
their office.

on 10/15/ 2009 15 minutes before 5 Warren Phillips called threatening that if I dint give him verbal agreement over the
phone stating I will commit to making $1,100 payments month for his attorney to frat and fax to me for a signature he would sell my
home tomorrow.

I told him I would not make any verbal agreement because on 8/22/2006 I was under the impression I was signing documents for a
refinance, and that was not true what makes you think I would make any verbal agreement over the phone. 

24. on 10/16/2009 I faxed Steven Windmueller  the Attorneys Draft, the escrow closing statement asking to take into
consideration the sale of my home and do what is right in regards of the loan I was given And take into consideration that It was
Taken by fraud.  they when ahead and again ignored me. . See Attachment # 24 Forward to Warren.

I was served with an unlawful detainer I need to say that the Attorney Representing this individuals is John E. Bouzane was placed
in probation with the California bar association.  I have filed A civil Law suit against with the san Bernardino superior court I had no
choice and filed pro se  I have contacted several well known Attorneys and have seen the malicious intensions of Warren Phillips And
his clan, I have not been able to retained their services due to my financial situation.

I don't have $6,000 nor $8,000 to retained an attorney, I do have faith that someone will come forward and help.  I can't believe
that anyone would risk losing so much for so little Warren Phillips Failed to act within the Law,  violated codes and
regulations that need  to apply when  providing  service to the public, he abused the power given to him as a public servant and
used the power to take from others what they have worked so hard for his own financial wealth.    Also blinded by greed he
failed does he represents placing them and exposing them as what they really are bunch of no good thief's.  I have asked Myself
many times how can someone that holds a respected social statues and is financially stable be involved and be part of fraud and
embezzlement.   I am talking about Steven F. Windmueller I believe is the Dean of the Jewish College of Los Angeles CA,

According to public records this individuals own many, properties which tittles are shared/own by them.

Fabian Malinovitz, according to public record has been involved in real estate disputes on a few federal court cases, and also has
plenty of properties himself, same with Sophia Lu, Martin Taft and Ethel Taft also Leonard Weinsaft, it seems as they are all business
partners. Partners In crime.

I will not give up, I will not be intimidated by this individuals nor by their Attorney he is an ambulance chaser, nor by anyone else.

I can't allow them to get away with any of what they have done, I have been told by many that is amazing I have not giving up

and that I have gone so far without giving up. I file my own civil case against this individuals, it seems that now I have to fight for
my rights in the court room with the Judge. I have been to court once, and I got the impression I has no say so, that as long as I'm
not represented by an attorney, justice won't be serve.
