The Appellant – Mohan A. Harihar, acting pro se, respectfully calls for this Court to provide a
detailed explanation for the record, as to HOW presiding Circuit Judges: Torruella, Kayatta
and Barron were ALLOWED to issue the referenced JUDGEMENT on January 17, 2018,
considering they LACK JURISDICTION. The Appellant has clearly articulated – IN FULL
PUBLIC VIEW, exactly how the evidenced claims against the presiding judges impact
jurisdiction. Despite these publicly evidenced claims, Circuit Judges: Torruella, Kayatta and
Barron have refused to provide ANY valid clarification. Instead, they’ve consciously chosen to
continue ruling WITHOUT jurisdiction, ignoring their judicial oath of office and the judicial
machinery of the Court. The Court is aware that it has become necessary to inform the President,
members of Congress, the FBI, DOJ and other Federal offices/agencies of criminal allegations
brought against these referenced Federal Judges. These Criminal allegations include (but are not
limited to) acts of TREASON under ARTICLE III, for continuing to rule WITHOUT

Administrative Office of US Courts. A formal complaint was filed to the direct attention of
Director James F. Duff, addressing a “Broken Process” pertaining to the handling judicial
misconduct complaints. A copy of the complaint is filed in the record of this Appeal.1
Therefore, for multiple legal reasons moving forward, please clarify exactly HOW the
referenced JUDGEMENT was allowed to issue. Please include exactly which related
documents were reviewed, and ANY OTHER factors which contributed to this decision. Any
failure and/or refusal to provide the requested clarification will be interpreted as contributing
Similarly, the Appellant seeks clarification from Clerk Margaret Carter, as to exactly HOW a
MANDATE was allowed to issue on March 23, 2018, and pursuant to Federal Rule of
Appellate Procedure 41(a), considering the unresolved jurisdiction (and other) issues. The Court
is aware that evidenced claims against referenced members of the Clerk’s Office and the Office
of the Circuit Executive include (but are not limited to) MISPRISION of TREASON under 28
U.S.C. 2382. Criminal complaints are now filed with the FBI against these parties.
Therefore, for multiple legal reasons moving forward, please clarify exactly HOW the
referenced MANDATE was allowed to issue. Please include exactly which related documents
