Re: Declining Representation

Dear Dr. Sklaroff:


In early January of this year, after becoming involved in my political campaign, you approached me
with an informal request for legal assistance regarding a pending Petition for Allowance of Appeal
before the Pennsylvania Supreme Court, which you filed pro se. As plaintiff in the underlying
matter, you alleged various violations of Pennsylvania's "Sunshine Act" by the Abington School
Board and certain members of the Board and/or administration. The original lawsuit, also filed
pro se, was dismissed by the Montgomery County Court of Common Pleas in response to the
Defendants' Preliminary Objections. Subsequently the Commonwealth Court, to which you
appealed pro se, affirmed the trial court's order. You filed a document you referred to as a "place-
holder" on the last possible day to file a Petition for Allowance of Appeal with the Pennsylvania
Supreme Court, and then forwarded material from the earlier stages in the case to me, requesting
my assistance.
I informed you immediately that as a practitioner, I have no experience handling matters arising
under the law upon which your suit was based. Nevertheless, you urged me to provide you with
legal advice, guidance, and/or representation. I informed you in turn that I was very reluctant to
take on this matter, but after initial review, I forwarded a copy of a recent Petition for Allowance of
Appeal I filed this past year for your consideration and for your use as a template to conform your
briefing to appellate procedural requirements. You insisted that this was insufficient and sought
further direct legal advice.
I have put in a significant amount of time reviewing the pleadings, objections, and appellate filings
in this matter, as well as researching the case-law cited, and other related case-law. As a courtesy to
a friend, and because I refuse representation, at this time I will tender no bill.
I must inform you however, as I have attempted to make clear repeatedly in the past, that I cannot
take on this matter as your attorney. Nor esn I provide any further general guidance in procedural
rules or requirements. Simply stated, I decline any representation or further communication in this
regard and must advise you that no attorney-client relationship has been, or will be, formed. You
are encouraged to seek consultation with a competent appellate attorney versed in the matters
addressed in your case.
