On September 11

Transnet in March introduced Voluntary Severance Packages (VSP) to employees I then applied but when
the contract came for signing I wasn't happy with some of the conditions thus did not sign 1- They wanted
to deduct relocation costs in the tune of plus R700 000as I heard recently relocated from Richards Bay to
Port Elizabeth in January 2017. 2 Bursary deductions. 2 May I reported back on duty but was told to not
come back the following day even though I have not signed the exit contract. 18 May I then received a call
from my union siting that they have in their possession a signed contract by me. 19 May I then went to the
office to investigate the matter it is on that day that I recorded one of the implicated employee it is the that I
learnt of the forgery. Our COO and HR Executive is aware of this matter as I have sent together with the
union statements stating my intentions of not signing the contract so they can't claim otherwise.

Untu Union has also refused representing me if I don't sign a letter exonerating them from any legal costs
that might arise from this case, I then appointed Strombeck Pieterse Attorneys to represent me. However
my hearing was postponed again as Transnet oppose me having legal representation non other than that
given by the Union, same Union I have on record as saying they think I signed the contract as that was
apparently my signature.

My brother that is the best I can come up with, to spice it up with can mention that as a result
of Transnet actions my farm is in a brink of closure as I retired to go into farming with that money, I have a
autistic special needs child who will not be going to school next year as a result, marriage is on rocky
grounds and have left me suicidal as I am unemployable because of this matter.

1- VSP was introduced due to bad economic climate in the country Transnet introduced this strategy in
order to avoid forced retrenchments.
2- Thandiwe Ngxingweni and I had a telephonic conversation on the 2 of May where she told me to not
report for duty the following day even though I had not signed the agreement contract.
3- The full name of the union is The United National Transport Union.
4- Douw Dreyer Untu's executive council member told me in a telephonic conversation on the 18 May and
subsequently Neels Haasbroek their Deputy General Secretary emailed me stating they will only represent
me only if I send confirmation that no legal suit will fall on their union because he has seen the contract and
he is convinced I signed I then stopped using them from that point.
5- I recorded our Hr practitioner Xolisa Ngcayichibi where in the recordings made a phone call to his boss
William Chapi asking them not to use that contract as it was incorrect but on the recording u call hear him
pleading with William saying they can't further back date this contract as it is wrong thus they were running
away from the fact that they had signed the contract dating 30 April but this wouldn't have been the case as
my manager was on sick leave and was in Gaunteng at the time and witness who signed was in
Butterworth.
6- I am a Quantity Surveyor who just relocated from Richards Bay to PE in January.
7- People who are aware of the fact that I left work without having signed any contract is Xolisa
Ngcayichibi, William Chapi and Thandiwe Ngxingweni but now it can be through a proper investigation
where we could no who did what when as it is not clear in the tapes.
8- Yes the is one more person I'm aware of but still need to call to get better information.
9- My brother want monies owed to me as per the VSP contract paid to me and pro-bono legal litigation on
the forgery case and a official apology by them personally in my farm so that they can see the impact made
by their subordinates.
Mr Unati Mafuya applied for the VSP and it was granted to him (see
attached
document). Then he was informed that he has to reimburse the company for
the
relocation monies paid to him. Apparently this is quite a huge amount.
He
then decided to withdraw his application for the VSP and return to work.
Up
to now he didn't sign the VSP contract.

He started the grievance procedure as well (see 2nd attachment). We


forwarded this issue to Gerhard. He referred us to Carl. He sent us to
Inbam. She referred us back to Carl. I even threatened him in an e-mail.
We
have received no response from him yet. This issue is dragging now for
more
than a week.

All what the person ask is that if he must pay the relocation money
back,
then he rather wants to return to work. Part of the VSP rules were that
you
can withdraw our application. As I mentioned he didn't sign the
contract.

It will be appreciated if you could intervene and resolve this matter.

I don't understand how an Employer can act with so much impunity under
union's watch and violate the very terms and conditions they have set
out
and force me to leave the office 2 May 2017 when I reported for duty,
and

With a sad result I have been advised to handle the matter outside of any union representation on grounds
that i was called by Untu's general Secretary asking me to write an affidavit relinquishing Untu on any legal
application that can reside from this grievance, on grounds that Untu has appointed hand writing experts
that have indeed verified that the fake signed VSP contract that has now surfaced is indeed signed by me.
