Abstract

India recently celebrated its 72nd Independence day. We have travelled a long way from how
we were in 1950s. But still today we consider a group of our citizen’s untouchable. They face
the same condition as people from lower caste in 1950s. They are always treated badly; nobody
is ready to hear their cry. They are not allowed to visit many places; they are not allowed to
show their real identity. Most of the times we can see Police service misbehaving with them.
So in totality they are not getting either Equality in opportunities or protection so how will they
get justice. The group of people whom the article is focusing is on are the LGBTs.
And the suggestion portrayed here is to bring an amendment in Section 377 of Indian Penal
Code,1860. The people from LGBT community are treated like they are not humans. They are
not given the right to show their real identity, to act according to their interest Even if we say
that our nation is independent, but these citizens of India have still have not tasted Liberty due
to a law apparently made by the Britisher. Is our nation truly Independent when some of the
citizens still live in cage? In this article the author would like to show that these individuals are
born in this way. Even many animals are Homosexual. We say that we are civilized, we are not
like animals, but i don’t see animals discriminating the Homosexuals like we do. They all live
together without any sort of problems being faced by the animal which is Homosexual. Many
Female Japanese Macaque attract to Female Japanese Macaque. Animals like Male Rams
exclusively live a life in which they only have or attract to male partners. Many study confirm
it that there is a biological basic for sexual preferences which are common for Humans and
Animals. Homosexuality has been observed in more than 1500 species. It is evidently clear that
animals are more broad minded that humans.
Further the britishers have removed this law from their legislation long back. We still tend to
give importance to our culture. Every culture in the world were against Homosexuality, because
it doesn’t appear to benefit the larger cause of species continuation. But a lot of protest was
initiated in many countries and as a result Homosexuality became legal there. The author will
also be mentioning the various countries in which protest were made and then the law was
removed due to the protest. Because they were ready to accept the view and see them in the
way as they like. Bottom-line they care for their citizens.
Our nation has a strong cultural identity which has been wrongly interpreted by the historians.
Kamasutra has a specific section which states the attraction of men towards men. The text say
that these moments generate lot of pleasure. Our Vedas were not completely against
Homosexuality. The author will be mentioning various parts of our Vedic history which shows
people were not against homosexuality. In fact our ancestors were more open to it. Many of
the instances in our Mythology suggest that being homosexual is not bad, but due to the
misinterpretation it is considered bad and the victims suffer.
The conclusion is that homosexuals are born in this way. Homosexual people are not acting
like this they are behaving. So since it is natural it is high time that an amendment must be
made in Section 377 and the citizens must be granted to their freedom.
