ZAIN’S MOBILE BROADBAND TERMS AND CONDITIONS

A. The ZAIN MOBILE BROADBAND service is a high speed data service that is offered as
part of ZAIN’s Mobile Data service on either our Post-paid or Pre-paid lines.

B. The ZAIN MOBILE BROADBAND service is offered on the terms and conditions of our
Post-paid or Pre-paid lines subscription as well as the terms and conditions set out
herein.

C. The terms and conditions set out here below are supplemental to either our Post-paid or
Pre-paid lines subscription.

Terms and Conditions

1. ZAIN MOBILE BROADBAND is our Mobile Data service offering using our GPRS/EDGE
technology.

2. The Mobile Data tariff rates apply in respect to the data traffic transmitted on both up and
down links.

3. The following uses of the ZAIN MOBILE BROADBAND service are unacceptable use of
the service and prohibited, and may result in the service being discontinued without
notice.

 Downloading, uploading or transfer of illegal, immoral, slanderous, offensive,

obscene material or any material that is subject to copy right, royalties or otherwise
protected under law, or any material that is capable of bringing into disrepute ZAIN
or its partners.

 Resale of the ZAIN MOBILE BROADBAND service without the prior written approval
of ZAIN.

 Any attempt to hack, reverse engineer or compromise any software or programs

provided as part of or supplemental to the ZAIN MOBILE BROADBAND service.

 Generation of spam emails, spam short messages (SMS) or spam Picture

messages (MMS); or any action that will bring harm to or degrade the ZAIN MOBILE
BROADBAND service or other services provided to you or others by ZAIN or a third
party.

4. You will for the duration of the subscription remain responsible for the use of the ZAIN
MOBILE BROADBAND service under the account number indicated herein and fully
indemnify ZAIN for any liability or claim, loss, costs, expense that ZAIN may incur as a
result of unacceptable use of the ZAIN MOBILE BROADBAND service.

5. The following uses of the ZAIN MOBILE BROADBAND service are acceptable:

 Downloading, uploading or transfer of any data from the internet or other sources
not listed as unacceptable in Clause 6.

 Web mail and email retrieval e.g. Hotmail, Yahoo, Outlook, etc.
  Installation and use of other supplementary services of ZAIN MOBILE
BROADBAND as made available by ZAIN from time to time, provided that said
services are not used to breach the provisions of Clause 6.

6. The ZAIN MOBILE BROADBAND service is a best efforts/endeavors service and the
quality and speed of data transmission may be affected by faults outside the control of
ZAIN such as user location, speed of travel, Internet congestion, local, geographic or
physical obstructions, atmospheric conditions and other causes of radio interference as
well as faults in other telecommunication networks to which the ZAIN network is
connected or dependent. The ZAIN network and ZAIN MOBILE BROADBAND service
may from time to time require upgrading, modification, maintenance or other works that
may result in the ZAIN MOBILE BROADBAND service or any part thereof becoming
temporarily unavailable.

7. You agree not to use the ZAIN MOBILE BROADBAND service for mission or life critical
applications and fully absolve ZAIN from responsibility arising from such use, and will
fully indemnify ZAIN against all costs, claims or liability direct or indirect arising from the
use of the ZAIN MOBILE BROADBAND service for such mission or life critical
application of the ZAIN MOBILE BROADBAND service.

8. You will take all necessary precautions to protect any device(s) you connect to the ZAIN
MOBILE BROADBAND service from viruses or other malicious software and absolve
ZAIN from any responsibility (legal or other) for any damage so caused in this regard.

9. The Mobile Data services are for your own use (home and office), they shall not be used
for commercial purposes. Commercial use is use of the service that involves the sale or
resale of the service to third parties e.g. running of a cyber cafe, etc. Evidence of
commercial use will lead to termination of the service. Further, Zain shall not be liable for
any loss of earnings and or business interruption (howsoever caused) resulting from the
commercial use of the Mobile Data services.

10. Save to the extent varied herein all terms and conditions of either our Post-paid or Pre-
paid lines subscriptions remain in full force and effect.

Fair Use Policy

1. The ZAIN MOBILE BROADBAND Fair Usage Policy is that customers should be able to
use the service in an appropriate manner to meet their needs. The Usage Policy is
designed to provide the most effective service to all Customers.

2. Only customers downloading in excess of 5 GB a month (1GB a day on daily plans) will
be affected by the Fair Use Policy. This is equivalent to downloading 5,000 emails with
1MB picture attachments each. ZAIN may communicate with these users to try and
establish what is driving the high usage and how individual usage patterns and habits
can be modified to the benefit of all.

3. In extreme cases, ZAIN may be required to apply management techniques to reduce the
impact that the heavy users have on the service performance of others.

4. If you use peer-to-peer applications use these applications considerately and send and
receive large files outside of peak hours. We reserve the right to terminate or suspend
the service (without any refunds on payment) if these applications have an adverse
effect on the Zain network.
