NOTICE OF VIOLATION

RE: Life Safety Inspection – Rochester Fair Grandstand Building

On Tuesday September 25, 2018 a life safety inspection was performed of the grandstand building
located on your property at 72 Lafayette Street. Our records and observations lead us to classify your
occupancy as an existing place of assembly within a type V (000) building. The following violations were
noted during the inspection.

1. NFPA 101 (2015) Section 7.2.1.4 – The code has requirements for the swing orientation and
force to which a door in a means of egress operates. All doors as part of the means of egress
shall comply, all were found to be deficient.

2. NFPA 101 (2015) Section 13.2.2.2.3 – All exits must be equipped with panic hardware. As such
the existing hasps and latches would need to be removed.

3. NFPA 1 (2009) Section 11.1.7.6 – Extension cords shall not be used in lieu of permanent wiring.
All extension cord use being utilized in this manner shall be discontinued and permanent wiring
installed in its place.

4. NFPA 101 (2015) Section 11.1.5.2 – The use of multi tap adapters shall discontinue per this
section.

5. NFPA 101 (2015) Section 7.8.1.2 – All means of egress must be continually illuminated and per
7.9.2.1 emergency illumination of the same means of egress shall be provided for not less than
90 minutes.

6. NFPA 101 (2015) Section 13.2.10.1 – All means of egress shall be equipped with illuminated
egress signs.

7. NFPA 101 (2015) Section 13.4.9.3.2 – The grandstand exceeds the allowable square footage and
length for this section.

8. NFPA 101 (2015) Section 13.4.9.3.4 – The highest allowed platform for seats is twenty feet. The
seating in the grandstand currently exceeds the allowance in this section.

9. NFPA 101 (2015) Section 13.4.9.2.5 – No portion of the seating shall exceed 16’6”. Current
sections exceed 16’6” and will need to be corrected.

10. NFPA 101 (2015) Section 13.2.5.6.4 – Variation in aisle stair treads exceeds allowable minimums
and shall be corrected.

11. NFPA 101 (2015) Section 13.2.5.6.3 – Aisle widths shall be upgraded to meet the minimum
allowances per this section.

12. NFPA 101 (2015) Section 7.2.2.4 – Aisles shall be equipped with handrails compliant to this
section.

13. NFPA 101 (2015) Section 13.2.5.6.10 – Aisle markings shall be provided in accordance with this
section.

14. NFPA 101 (2015) Section 10.2 – Interior finishes are non-compliant and must meet the minimum
requirements of this section.

15. NFPA 1 (2009) Section 19.2.1.1.1 – All rubbish containers larger than 40 gallon require lids. No
lids were found for any of the containers.

16. NFPA 101 (2015) Section 13.3.4.1.1 – Per this section the building requires an NFPA 72
compliant fire alarm system. The current system does not meet the minimum requirements.

17. NFPA 101 (2015) Section 13.3.5.2 – The building’s current sprinkler system must be surveyed by
an FPE to ensure its design and installation meet the requirements of NFPA 13 for the occupancy
and use. Per this section the building shall be protected throughout by a compliant automatic
sprinkler system.

18. NFPA 1 (2009) Section 10.4.1 – Submit documentation showing that the current fire alarm
system installed in the building has been maintained, inspected, and tested in accordance with
NFPA 72 (2013).

19. NFPA 1 (2009) Section 10.4.1 – Submit documentation showing that the sprinkler system
installed in the building has been maintained, inspected, and tested in accordance with NFPA 25
(2014).

20. NFPA 25 (2014) Section 4.8 – The fire department connection on the rear of the building to the
sprinkler system needs to be repaired. The swivel connection is seized, the cap is missing, and
debris within the pipe needs to be removed.

21. NFPA 1 (2009) Section 10.12.1 – New and existing buildings shall have approved address
numbers placed in a position to be plainly legible and visible from the street or road fronting the
property.

22. NFPA 1 (2009) Section 18.2.2.1 – The fire department key box was found to not have adequate
keys for access to all building on site. Please provide those for the key box.

23. NFPA 1 (2009) Section 11.1.10 – Some junction boxes were found in the maintenance area
without a required cover. All panel boards and switch boards, pull boxes, junction boxes,
switches, receptacles, and conduit bodies shall be provided with covers compatible with the box
or conduit body construction and suitable for those conditions.

24. NFPA 1 (2009) Section 10.19.5.1 – Discontinue storage in mechanical and electrical rooms.
Combustible material shall not be stored in boiler rooms, mechanical rooms, or electrical
equipment rooms.

25. NFPA 25 (2008) Section 13.2.3 – Storage blocking the sprinkler riser must be removed to provide
access to the riser. All system valves shall be protected from physical damage and shall be
accessible.

26. NFPA 72 (2013) Section 10.6.5.4 – The circuit breaker powering the fire alarm control panel
must have a listed breaker lock attached to it per this section of the code.

27. The paper faced insulation located in the ceiling of the workshop must either be removed or
covered as per manufacturer’s specifications.

28. There is excessive clutter in the rear hallway that impedes egress. This needs to be addressed.

29. Any gas piping that is abandoned must be appropriately labeled as such or completely removed.

Because of the scope and complexity of the fire and life safety code violations relative to the sprinkler
system, fire alarm system, egress components and building construction we will require a
comprehensive plan from you that details how the building will be brought into code compliance. This
plan must be developed by, or reviewed and signed by, a New Hampshire state licensed fire protection

engineer. We will need proof that these deficiencies are being addressed within thirty days of this
violation letter. Whereas it is reasonable to assume that it may take longer than the thirty days to
resolve some of the deficiencies as well as establish a plan of correction through a fire protection
engineer, we may accept a letter of confirmation from your contracted fire protection engineer that
details the timetables for completion on their report. The timetables must be agreed upon by the fire
department.

We expect to hear back from no later than November 9, 2018.
