Stoga emo se U sledecin nekolko re¢enica pozvati na objagnjenja FIDIC-a uz njegova nova izdanja, da bismo otklonili nedoumice korisnika, FIDIC-ove Crvene i Zute knjige (fj. standardni obrasci ugovora za gradevinske radove i elektrotehniéke | masinske radove) éesto se koriste vet nekoliko decenija i stekle su priznanje, pored ostalog, zbog niihovih principa fer i praviéne podele rizika izmedu investitora i izvodaéa. Ovakvi principi podele rizika su bili korisni za obe strane zbog toga &to investitor zakijuéuje ugovor po nizoj ceni i snosi dodatne trokove samo u slu- éaju eventualnin neobiénin rizika, a izvodat nema potrebu da utvrduje cenu takvin te8- ko procenjivih rizka Tokom postednih nekolko godina, medutim, zapazeno je da postoji potreba i za ugovo- rima u kojima se utvrduje konaéna cena i dan zavréetka radova. Kod takvih projekata izvodaé. snosi znatno veée rizike od onih koji su predvideni tradicionalnim Crvenim i Zutim knjigama, Zarad vece izvesnosti u pogledu Konatne cene, od izvodaéa se cesto zahteva da pokrju éak i rizike vezane za pojavu loSeg ii neotekivanog tla, a dogada se da investitor ak ne snosi ni neke rizike koji su vezani za ratno stanje, terorizam i sliéno, kao / ostale rizike od okolnosti vi8e sile. Otigledno je da ée izvodaé u tom sluaju s punim pravom poveéati svoju ponudenu cenu da bi pokrio takve poveéane rizike. Za navedene zahteve i potrebe, posebno za BOT arandmane, FIDIC je publikovao novo izdanje Zute knjige | tzv. Srebrnu knjigu koje zamenjuju tradicionalno izdanje Zute knjige, koje je pred vama. To, medutim, ne znaéi da ona nije u primeni, pogotovo u © tome svedodi i narutilac prevoda ovog izdanja tzv. tradicionalne Zute knjige — kompanija Mace d.0.0. Uostalom, kao Sto pokazuje praksa, nema gotovih re8enja koja se mogu mehanitki primeniti, bez prilagodavanja Konkretnim okolnostima. A to je, ujedno, jo8 jedan razlog za8to postoje i konsultanti i ovo je prava prilika da vas obavestimo da iz Stampe izlazi i najnovije, éetvrto izdanje tzv. Bela knjiga (2006), u kojoj publikujemo model ugovora o pruganju usluga izmedu investitora i konsultanta (Client/Consultant Model Services Agreement) lzdavaé Beograd, Mart 2008. ee | BRaAR ee ee | Dear users, What you are looking at is the new, corrected edition of the traditional Yellow Book, which has been translated much better than the first edition we had published in 2007. The fact that now there also exists a new FIDIC Yellow Book could cause confusion. That is why we are going to refer in the next few sentences to the FIDIC explanations ‘concerning their new editions in order to dispel the users’ confusion. FIDIC's Red and Yellow Books (ie. standard forms of contract for works of civil engi- neering construction and for electrical and mechanical works) have been in widespread Use for several decades, and have been recognised - among other things ~ for their principles of fair and equitable risk sharing between the Employer and the Contractor. ‘These risk sharing principles have been beneficial for both parties, the Employer sign- ing a contract at a lower price and only having further costs when particular unusual risks actually eventuate, and the Contractor avoiding pricing such risks which are hard to evaluate, During recent years, however, it has been noticed that there is also a need for contracts fixing the final price and date of completion of works. In the case of such projects, the contractors bear much greater risks than those referred to in the Red and Yellow Books. For the sake of greater certainty with regard to final price, contractors are often required to cover even the risks of bad or unexpected soil conditions, while on the other hand, clients do not bear some of the risks associated with a state of war, terrorism and the like, as well as other Force Majeure risks. Itis clear that in such cases, the contrac- tors are fully justified in increasing their bids in order to cover the thus increased risks. In view of the mentioned requirements and needs, particularly in the case of 8.0.T. contracts, FIDIC has published the new edition of the Yellow Book and the so-called Silver Book as replacement for the traditional Yellow Book you are looking at. That, however, does not mean that it is non-applicable, in Serbia in particular. This is corro- borated also by the party which has ordered the translation of this edition of the so- called traditional Yellow Book — the Belgrade branch of the prominent British Mace International Consulting and Engineering Company. In any case, experience has shown that there are no solutions which can be applied mechanically, without adjustment to actual circumstances. That is, afterall, yet another reason for the existence of consultants and a good opportunity to let you know that the latest, fourth edition of the so-called White Book (2006) ~ Client/Consultant Model Ser- vices Agreement ~ is about to come out Publisher Belgrade, March 2008
