Upon arival on seen officers met two females outside of the addres, The females identified themselves a RGSS ne AOC. Ms SIBstatd that they had an unwanted goes inside of her apariment andhey Wanted bim out of the dwelling, Ms. IMM that ‘he persun inside ofthe spariment i "kind of her boyfiend and she wanted hmm to leave. At this time officers were led to the font door ofthe apartment by both females. During this time [asked Mlilmand Vis. slip fv male had ang weapons at which ime they stated thet they ddat now. Ms. puntocked ‘he font door and let oftiers inside the apartment. (Once inside the apartment officers conducted a protective sweep ofthe downstairs. As officers were -hecking the living room, one ofthe females advised affcers thatthe bak door was wide open and that she »bserved fiesh footprints in the snow outside and believed thatthe male let dhe home, Even though it was, delieved at this time that the subject had left the apartment, both females insisted that we continue checking lhe house to make sure thatthe male was not sill there. Officers checked both ofthe upstairs bedrooms, and ‘he bathroom as well asthe downstairs basement. Officers were unable to locate the male subject at that time. Officers then advised Ms. 4@ij@and Ms.AAQW@ that we would conduct a check of the area in an atiempt to ‘cate this male subject. At that point in time, no crime had been reported as having taken place. Officers the apartment and advised both Ms, dj@and Ms. Qo call us back ifthe male returns. During ‘his time officers could also hear loud banging coming from what appeared to be the area ofthe back door to ‘the residence. Officers proceoded to the back ofthe dwelling in order to investigate. As officers tured the ‘comer we observed Liste nal, who was lates ideatified as Roberto Perez, banging on the back doos. “The area near the back door wes not well lit, but officers could observe a beat windovr screen that had been ‘removed fom the back window and was laying on the ground. I ordered Mr, Perez to stop what he was doing tnd to come speek with ws, at which ime Mr. Porez ignored my request, began to pace back and forth and ‘Stated 1 reach into his waistband. Mr, Perez stated leave me the fuck alone Yor I wil shoot you". Mr. Perez ‘continued to each into his waistband arca-- Officer Wajdula pointed his department ised taser and advised” ‘Mr. Perez to show us his hands. Mr, Perez continued to ignore verbal commands and kept reaching with bot ‘hands toward the area of hs waistband while pacing back and forth I pulled out my department issued firearm and Officer Wajdola transitioned to his ream as well. Mr, Perez tuned his body slightly away from ts and again reached into his wsisthand area, at which point Mr. Perez pulled something out and quickly fumed his body back toward offices. AC that time, Mr, Perez had in his hnds a black object that appeared to bea firearm, [then yelled several commands for Mr. Perez to drop his weapon, duting which time Mr, Perez stated "Tin gonna shoot you." Mr, Peez raised and extended his rms, pointing the object in his hands toward ‘officers in the same fashion that trained individual would point a firearm. A‘ that time, Mr. Pevez was Approximately twenty fet away from Officer Wajdula and . Mr. Perez, while sll pointing the object at ws, then began to charge at Officer Wajdula and I. Believing thatthe charging Mr. Perez was going to shoot at officers with a firearm he was holding, both officers made the decision to discharge their weapons in order to defend themselves and o stop the threat posed by Mr, Perez. Officer Wajdula fired approximately 8 rounds ‘while [fred 2-3 rounds at Mr, Perez. Ibeliove that Me. Perez was struck in the buttocks area, perhaps twice. Mr. Perez fell othe ground. At the point where he weat tothe ground, Mr. Perez had closed the distance between him and the officers by several fet from where he begsn charging a us. ‘Once Mr. Pete fll to the ground, Officer Wajdula and I cerefully approached him at which time Officer ‘Wajdiula placed him into handeaffs a I covered him to make sure thal Mr. Perez was no longer a threat. Officers observed that the black object which was believed to be a firearm in Mr. Peres hand was a cell phone, [hen notified dispatch that ofTcess discharged their firearms and needed an ambulance and a supervisor on scene, Iran back to the cruiser in order to retrieve a medical bag to provide medical attention for Mr. Perez while waiting forthe ambulance to arrive on scene. Officer Wajdula and I observed what appeared tobe two gimshot wounds to his fe bullocks area. Zanazanian and Set. S. Linnehan to go to the hospital tobe checked out per department protocol, ‘Once the scene was secured the Major Crimes Unit under the direction of Captain T.
