NOTIFICATION OF RECOMMENDATION FOR TERMINATION
Itis my recommendation to terminate the employment of Lieutenant Jose Ramirez
The grounds for this decision are, generally, his repeated acts of insubordination, dishonesty,
and his dismal performance as the second highest ranking member of this Department. He has
violated explicit employment standards of the City of Rincon as set forth in the City’s Personnel
Policy Manual (PPM), the policies and procedures set forth in the
City of Rincon Police Department's Standard Operating Procedures (SOP), my explicit
instructions to him, and the reasonable standards of performance that should be obvious to
any competent law enforcement manager.
While my initial evaluation of the Department's resources and needs at the beginning of my
tenure as Chief revealed thet his performance both as Operations Commander, and as Interim
Police Chief had been grossly inadequate, my recommendation is based primarily upon his
actions and failures since the start of my service as Police Chief. However, it takes into
consideration events occurring shortly before my tenure as Police Chief began that continue to
reverberate with adverse consequences within the Department. It further is based on his.
continued pattern of behavior whereby his refusing to accept accountability for conditions
arising or existing under his leadership. He has failed to correct both his active and passive-
ageressive resistance to my efforts to make the improvements to achieve those objectives |
have established for this Department in consultation with the Mayor, City Council, and City
Manager. Lieutenant Ramirez's repeated attempts to undermine me and my authority before
persons both within and outside of the Police Department have included gross misconduct,
including untruthfulness, insubordination, and negligence.
The City has a right to expect higher standards of performance and behavior from higher-
ranking managers than it does from its rank-and-file employees. Any of the violations noted in
this memorandum would be sufficient cause to recommend his termination. The cumulative
effect of these behavioral and performance inadequacies compels me to make this
recommendation for the good and efficient operation of the City of Rincon Police Department.
