Question 1 Farid has obtained a monetary judgment against 3 defendants namely, Salwa (for

RM250,000), Sangeet (RM350,000) and Steven (RM120,000). The judgment against Salwa was
obtained on 2.3.2010 while the judgments against Sangeet and Steven were obtained on 3.1.2011
and 1.1.2012 respectively. Salwa owns a piece land in Bangi. Sangeet works as a clerk in Kementerian
Kesihatan Malaysia and also a songwriter who receives royalties for her songs from recording
companies. Steven has RM150,000 in his savings account with CIMB Bank but owes RM10,000 to the
Bank for his overdraft facility. Farid now seeks your legal opinion on how he can execute those
judgments. Advise him.

 If 6 years has elapsed- passed limitation period. Apply for leave according to order

RM 150,000 in CIMB savings account, owes CIMB RM 10,000 in overdraft facility

I. Salwa
Writ of Sale & Seizure. Prohibitory Order, Order for Sale.

II. Sangeet
 Judgment Debtor Summon
 Section 4 of the Debtor Ordinance 1957 provides for the issue of summons by the
judgment creditor against the judgment debtor for the purpose of bringing the
judgment debtor to court and orally examine him or his ability to pay or satisfy the
judgment debt and to discover under oath the whereabouts of his property.
 Order 48 (Procedure on page 435)
 Court may after examining financial capabilities of JD order for payment by
instalment, if JD defaulted this payment then can proceed with committal order.

III. Steven
 Garnishee Proceedings (page 424) – only RM 140,000.00
(NOT THE OVERDRAFT)
 But in this case he only owes RM 120,000.00
Question 2 Diana has obtained monetary judgment against Ramli for RM500,000 on 31.3.2015 and
against Daniel for RM250,000 on 1 April 2009. Both Ramli and Daniel refused to settle the judgment
sum. Ramli owns a house in Kuala Lumpur and has RM250,000 in his bank account. He is also a full
time employee at Golden Screen Sdn. Bhd. Daniel is a business man. He is owed an amount of
RM100,000 by his client, Dangerous Sdn. Bhd. Diana was also informed that Daniel has submitted a
claim for RM150,000 to another client, ABC Enterprise but the said claim has been refuted by the
said company.

i. How can Diana enforce these judgments?


ii. ii. Can Diana institute garnishee proceedings against Dangerous Sdn. Bhd. And ABC
Enterprise?

Ramli (RM 500,000.00)

ABC Enterprise (RM 150,000.00- but disputed)

It must be emphasized that if a garnishee disputes the debt owing to the judgment debtor, then the
court may not order garnishee order to be absolute. (end of pg 423) Kena pergi trial.
Fazura mempunyai dua buah rumah sewa di Taman Permai, Kuala Lumpur. Beliau telah
menyewakan rumah-rumah tersebut kepada Fattah dan Fahrin. Perjanjian Penyewaan antara Fazura
dan Fattah telah pun ditamatkan ekoran kegagalan Fattah membayar tunggakan sewa. Untuk itu,
Fazura telah memfailkan Writ dan permohonan dibawah Aturan 14 Kaedah-Kaedah Mahkamah 2012
ke Mahkamah Sesyen menuntut tunggakan sewa sebanyak RM50,000 dan suatu perintah untuk
mendapatkan kembali milikan kosong rumah tersebut. Tuntutan Fazura tersebut telah didengar di
Mahkamah dan pada 3.3.2013, Mahkamah telah memberi penghakiman menyebelahi Fazura seperti
yang dituntut.

Dalam pada itu, Perjanjian Penyewaan antara Fazura dan Fahrin telah ditandatangani pada 1.6.2017
dan masih berterusan hari ini (9.3.2018). Malangnya, Fahrin telah gagal untuk menjelaskan sewa
bulanan dari bulan September hingga ke hari ini (9.3.2018) tetapi masih lagi mendiami rumah
tersebut. Fazura belum memulakan sebarang tindakan undang-undang di Mahkamah.

Nasihatkan Fazura mengenai isu-isu berikut:

(1) Bagaimanakah bentuk pelaksanaan penghakiman yang boleh diambil oleh Fazura untuk
menguatkuasakan Penghakiman bertarikh 3.3.2013 terhadap Fattah. (5 markah);
Writ of Possession – must terangkan how it works according to the facts and explain
procedure.
No more chance since tenancy agreement has been terminated.

(2) Apakah langkah yang boleh diambil oleh Fazura untuk mendapatkan jumlah tunggakan sewa
dari Fahrin sedangkan Perjanjian Penyewaan antara mereka masih berterusan. (5 markah);
dan
Only wants rental- distress.

(3) Secara am, terangkan bentuk pelaksanaan yang boleh dibuat untuk menguatkuasakan
‘monetary judgment’. (5 markah)

EXTRA NOTES

Distress- ex parte -to get bayaran tertunggak from tenant , can lelong barang in the rumah as well if
not paid.

To enforce judgment for possession of land : (THIS ONE IS FOR LANDLORD AND TENANT OTHERWISE
USE WRIT OF SEIZURE AND SALE)

 A judgment or order for the delivery of possession of land may be enforced by a


Writ of Possession or in a case where O. 45, r.5 applies by a Committal Order.
 Landlord- tenant still need to get writ of possession (even if tenancy agreement has
ended ). Specific Relief Act Section 7, or landlord can charge double rent for the time
where tenancy has ended but vacant possession has not been given.
 The Writ of Possession in Form 90 commands a sheriff to enter into the land and
take possession of the immovable property.
 A writ of possession for immovable property cannot be issued without a leave of
court except in charge action where Order 83 applies.
 Such leave shall not be granted unless it is shown that every person in actual
possession of the whole or any part of the property has received such notice of the
proceedings as appears to the court sufficient.

 Committal Order – This procedure is available when a person disobeys the judgment
or order of court. (O.52)

 Must obtain leave for committal. Application for leave must be made ex parte
supported by statement setting out name and description of applicant as well as
person sought to be committed, grounds, affidavit.
