In the event of a breach the covered entity must notify the U.S Department of Health and
Human Services.

In the event that a breach has affected an organization then the covered entity must notify the
Secretary of the incident within 60 days of knowledge of the breach. An online breach
notification form must be filed from the HMS website.

For a breach involving fewer than 500 affected individuals the covered entity must contact the
Secretary sometime within 60 days of the calendar year of when the breach was discovered. An
online breach notification form must be filed from the HMS website.
