AMENDMENT TO HEAD COACH CONTRACT This Amendment to the Head Coach Contract between the State University of Iowa (University) and Michael Bond Shymansky (Coach) effective July 1, 2017, is attached to and incorporates by reference all of the terms and conditions of the Head Coach Contract between University and Coach effective February 3, 2014, except as modified herein. If not amended below, then all other terms from Appendix B remain, ‘The parties hereto promise and agree as follows: 1. Paragraph 1 of the Head Coach contract dated February 3, 2014 is hereby amended to delete the following language: 1. EMPLOYMENT University hereby employs Coach as Head Coach of Volleyball (“Team”) for the period from the 3" day of February, 2014, through the 30" day of June, 2020. The Parties agree that at the conclusion of the 2015-2016 volleyball season, they will meet to discuss the possible revision and/or extension of this Contract. If revision and/or extension is determined {o be of mutual benefit, this Contract shall be amended in writing accordingly. And replace it with the following: 1. EMPLOYMENT University hereby employs Coach as Head Coach of Volleyball (“Team”) for the period from the 1* day of July, 2017, through the 30 day of June, 2022, and shall automatically renew for additional one-year periods on July 1 unless notice of nonrenewal is provided by the University pursuant to Paragraph 12 below. Coach agrees to and hereby accepts employment in this position and agrees to faithfully and diligently devote his effort to the performance of the duties of this position. 2, Paragraph 3 of the Head Coach Contract dated February 3, 2014 is hereby amended to delete the following language: 3. SALARY University agrees Coach will be paid a guaranteed annual salary as, follows: Base Salary* $165,000 *The first time an incentive in Paragraph 4.B.1. (Recurring Annual Incentive Compensation) is achieved, base salary shall automatically increase by amount of incentive achieved effective July 1 of the year following the achievement. Thereafter, similar base salary adjustments are not guaranteed. For each following year of the contract, subject to the discretion of the Director of Athletics, Coach will be eligible for an adjustment to base salary provided it is supported by exemplary conduct, positive performance, and market. The salary shall be payable to Coach consistent with University and state rules and regulations in 12 monthly installments in accordance with the payroll policies of the University and subject to such deductions as may be required by applicable laws or regulations. University shall have the option of offering raises to Coach during the remaining years of this Contract. Coach agrees that the University may initiate payroll deductions for non- University expenses paid by the University but which are the personal responsibility of Coach. And replace it with the following: 3. SALARY University agrees Coach will be paid a guaranteed annual salary as follows: Base Salary* $215,000 *The first time an incentive in Paragraph 4.B.1. (Recurring Annual Incentive Compensation) is achieved, base salary shall automatically increase by amount of incentive achieved effective July 1 of the year following the achievement. Thereafter, similar base salary adjustments are not guaranteed, Future base salary adjustments will be at the discretion of Athletics Director based on performance and market, ‘The salary shall be payable to Coach consistent with University and state rules and regulations in 12 monthly installments in accordance with the payroll policies of the University and subject to such deductions as may be required by applicable laws or regulations. University shall have the option of offering raises to Coach during the remaining years of this Contract. Coach agrees that the University may initiate payroll deductions for non- University expenses paid by the University but which are the personal responsibility of Coach. 3. Paragraph 4 of the Head Coach Contract dated February 3, 2014 is hereby amended to delete the following language: 4. RECURRING ANNUAL INCENTIVE COMPENSATION University agrees Coach will be paid annual incentive payments should he meet the academic, athletic, and longevity criteria described in this paragraph. Any such payment(s) will be made within sixty (60) days of the date of meeting, the criteria: A. Academic Success Achieving a team Academic Progress Rate (APR) of .980 or higher, or a 6-year Graduation Rate (GSR) of 100%, as determined by the NCAA. Graduate Report Athletic Success: Big Ten NCAA Highest level eared of first 3 contract years: 4 Big Ten Wins (First 3 years) 6 Big Ten Wins (First 3 years) 8 Big Ten Wins (First 3 years) Highest level eamed, not cumulative: ‘Top 7 Finish in Big Ten Conference or NCAA Qualifier Big Ten Regular Season Title Highest finish applies: $10,000 $10,000 $15,000 $20,000 $20,000 $25,000
