CITY ORDINANCE NO. 2009-09

“AN ORDINANCE AMENDING CITY ORDINANCE NO. 2008-01,
ARTICLE IX, SECTION 80, ITEM NO. 2 (CITY GYM SPACE RENTAL)
FROM P 10.00 PER SQUARE METER TO P 4.00 PER
SQUARE METER PER DAY.”

WHEREAS, referred to this Committee for appropriate action is the

LEAD-BC Regulatory Board Resolution No. 2009-01, a resolution requesting the
Sangguniang Panlungsod to amend City Ordinance No. 2008-01, Article IX,
Section 80, Item No. 2 (City Gym Space Rental) from P 10.00 per square meter
to P 4.00 per square meter per day;

WHEREAS, it is the consistent policy of the City Government to actively

support the City’s Business Sector in its pursuit for economic development and
progress by installing mechanisms aimed to ease the burden in their business
operations;

WHEREAS, after a thorough study and extensive deliberations, this

Committee finds the LEAD-BC Board Resolution No. 2009-01 which seeks to
lower the leasehold rate of the store spaces in the City Gymnasium meritorious
given the conditions under which the leaseholders of stalls in the City Gym
are operating, to wit:

a. The business activity in the City Gym is largely dependent upon the
events held in the City Gym;
b. There are more days that no event is held in the City Gym than there
is, which means generally lesser sales opportunities for the businesses
operating in the City Gym;
c. The store spaces in the City Gym considered functional is actually
smaller than is computed by floor area due to the declining ceiling
utilized as bleachers above;
d. Due to the prohibitions to sell liquor in the vicinity of the City Gym
imposed by our City laws, store operators are relatively restricted in
their business activities;

WHEREAS, a financial analysis made by the Office of the LEAD-BC

showed that the reduced rate of P 4.00 is equitable and reasonable.

NOW THEREFORE

BE IT ORDAINED, by the 1st Sangguniang Panlungsod, in its 84 th

Regular Session assembled, that:

SECTION 1. The City Ordinance No. 2008-01, Article IX, Section 80, Item
No. 2 which reads :

“Section 80. FEES AND CHARGES.

(1) X X X X

(2) City Gym Space Rental - P 10.00 per sq. mtr. /day”

(3) X X X X”

is hereby amended to read as:

“Section 80. FEES AND CHARGES.

(1) X X X X

(2) City Gym Space Rental - P 4.00 per sq. mtr./day”

(3) X X X X”

SECTION 2. This Ordinance shall take effect immediately upon

approval.
