GENERAL CONDITIONS

Our offer for the Treatment Plant will also be governed by the following
conditions:
1 Our offer provides for only those items listed under Civil specifications
in our offer. Any modifications thereof and/or other items not specified
in our offer, if required to be done shall be considered as an extra item
to be paid.
2 We will undertake the trial run and maintenance of the plant for the
period upto 6 calendar months, during which period performance test
will also be carried out on the understanding that you will provide free
of cost the following to us:
a. All consumable stores like chemicals, electric power and raw
water.
b. Supervisory staffs and unskilled labour necessary for testing the
plant. Such requirement shall be intimated to you from time to
time.
3 If the work is delayed
a. By force majeur
b. By reason of exceptionally inclement weather
c. By reason of civil commotion, strike or black out, scarcity of
power thereby affecting the execution of the work and law and
order problem.
d. By reason of your instruction, or delay of your instruction
e. By reason of non-approval or non-certificate of the work requiring
your representatives’ specific approval before proceeding further
with the work soon after the work is ready for being proceeded
with
f. Due to non-payment of our progress bills
g. Due to delay in approval of drawings
h. Due to any legal obligations/proceedings that may arise
Then in all such cases a reasonable extension shall be granted to us.

4 We will not take any responsibility for damages or destruction to the


structures arising out of natural calamities such as earthquakes,
landslides etc and due to civil disturbances such as riots etc. during the
construction period.
5 The break up schedule of Civil work to facilitate payments will be
submitted after award of the work for your approval.
6 As the work is to be executed by our own design and drawings, we
shall have the right to make any alterations to the same at any stage of
the work not withstanding that the design and drawings may have
already been submitted to and approved by the purchaser without any
change in the contract price provided that such alterations do not
involve any effect on the performance and the capacities of the plant.
Such alterations shall be carried out after mutual discussion.
7 Specifications:
We shall adhere to the specifications as mentioned in the NIT,
wherever silent, the specifications of the Water Supply Manual/CPWD
shall be governing and binding.
8 Mobilisation Advance:
20 % mobilisation advance of the tendered amount will be given by the
department.
9 Mode of Payment:
Necessary break-up schedule for each units shall be submitted for
making necessary payments
10 Schedule of Work:
We shall furnish the detailed working drawings within four weeks after
placing of work orders and shall complete the work within 18 months
as specified in the NIT of award of the works reckoned from the date
of approval of the drawings provided construction site is made ready
by the department.
11 The site should be handed over immediately after award of the contract
for execution of the works.
12 Price escalation is as per the NIT conditions.
