STOPPAGE OF CHANGE OF HOUSING COLONY FROM
“HAMZA GARDEN” INTO “SATTAR GARDEN”.

Vide PUC-I, Mr. Amir Sattar S/o Abdul Sattar cast Rajpoot R/o
Chak No.97/9-L, Wakeelwala, Sahiwal, on 11-02-2016, stating therein
that he has owned agricultural piece of land, measuring
75-Kanals 1-marlas, out of Khawat No.4 & Khatooni No.10&13, Khasra
No.29//3/2,4,5,6,7,8/1,13/2,14,15,16,17,18/1,22,23,24,25, situated at Chak
No. 97/9-L, Teshil & District Sahiwal. He intends to convert this site in to
Residential purposes for establishment of “Hamza Garden Housing Scheme”
and requested that necessary NOC may be issued in his favor.
2. After that, Vide PUC-II, he submitted another application with the
request to change of name of “Hamza Garden Housing Scheme” into
“Sattar Garden Housig Scheme”.
3. Vide PUC-III, Mr. Hamza Yaqoob S/o Abdullah R/o Noor Parak,
Sahiwal, submitted an application with the request to avoid to change of name
from “Hamza Garden Housing Scheme” into “Sattar Garden Housing
Scheme”.
4. The both of applications were sent to the District Officer (Planning),
District Council, Sahiwal for factual report alongwith specific recommendations in
the light of above said applications under the provisions of concerned
rules/law/polices vide this office letter Nos.329-TSC/CA/SWL Dated 13-12-2018
and letter No.346-TSC/CA/SWL Dated 19-12-2018 (F/A&B).
5. The District Officer (Planning) sent a report vide his office letter
No.87/DOP/DC/SWL Dated 07-01-2018, stating there in that there is no file
under processes in his office by the name of Hamza Garden situated at Chak
No. 97/9-L Wakeelwala, Sahiwal, except a scrutiny fee receipt issued by Tehsil
Municipal Administration, Sahiwal dated 08-03-16, neither any document has
further been submitted in his office to proceed further on approval of the scheme
nor any NOC/Layout plan has been issued by the office with the name Hamza
Garden. He further stated that his office may proceed on approval of scheme
with the name by which NOC for Condonation fee will issued (F/C).
6. It is pertinent to mentioned here that on receiving of application
PUC-I, reports were called from Revenue Field Staff and NTO, Sahiwal. The
requisite reports have been received in the name of Hamza Garden (F/D&E).
Furthermore, the name of Hamza Garden Housing Scheme has also been
included in the list for forensic audit.

7. On receipt of application under PUC-I, a fact finding report was


called from the Assistant Commissioner/Tehsildar and N.T.O, Sahiwal. It has
been reported by the Revenue Field Staff/Assistant Commissioner, Sahiwal that
as per RHZ for the year 2009-10, Mr. Amir Sattar S/o Abdul Sattar cast Rajpoot
R/o Chak No.97/9-L, Wakeelwala, Sahiwal is applied for NOC for establishment
of Hamza Garden Housing Scheme comprising land measuring
75-Kanals 1-Marlas, out of Khawat No.4 & Khatooni No.10&13, Khasra No.
29//3/2,4,5,6,7,8/1,13/2,14,15,16-min,17-min,18/1,22-min,23,24,25, situated at
Chak No. 97/9-L, Teshil & District Sahiwal.

8. As per record of Rights for the year, 1956-57, provided by the


applicants and report of NTO, Sahiwal reveals that before partition the
afore-stated land was owned by Rai Bahadur Bassa Singh (migrant). After
independence, the land became Evacuee property, under the possession of
Commissioner, Rehabilitation Department to the care of Tahseen Ali Khan etc.
”Taaiyundaran”. As per Register Haqdaran Zameen for the year, 1961-62 Misal
Haqeeyat Ishtamal, the afore-said land was under the ownership of Abdul Sttar
S/o Khursheed Ali in Khawat No.2 & Khatooni No.6. In accordance with the
Register Haqdaran Zameen for the year 2009-10, Mst. Sadaf Amir W/o Amir
Sattar is owner of land comprising Khasra No.29//14 to 17,18 in Khawat No.3
Khatoni No.8, Mr. Arham Sattar s/o Amir Sattar is owner of land comprising
Khasra No.29//18/1,3/2,4,5/1,6,7,8/1,13/2, in Khawat No.5 Khatoni No.13 and Mr.
Amir Sattar S/o Abdul Sattar is owner of land comprising Khasra
No.29//22,23,25, in Khawat No.4 Khatoni No.13.

9. In the light of above said reports a verification of land owned by the


Mr. Amir Sattar was called from ADLR, Arazi Record Center, Sahiwal Vide this
office letter No.69-TSC/CA/Swl (F/F). As per report of ADLR, Arazi Record
Center, Sahiwal received vide this office letter No.nil dated 28.01.2019,
Mr. Amir Sattar S/o Abdul Sattar is owner of total land measuring
72-Kanal & 13-Maral in Kawat Nos.4&5, comprising Khasra
No. 29//3/2,4,5,6,7,8/1,13/2,14,15,16,18/1,22,23&25. Copies of RHZ & report is
attached at (F/G). .

10. As per existing policy of the Govt. of the Punjab, contained in the
Board of Revenue, Punjab, Lahore letter No.4066-83-VI/3292-CS, dated
07-11-1983 (F/F), an extract, reproduced below and read with the Board of
Revenue Punjab, Lahore, letter No.2586-94/3489-CSVI, dated 26-10-93 (F/G),
No Condonation fee is leviable on such lands. As such the applicant has
requested for the issuance of No Objection Certificate in this respect for
conversion of Agricultural piece of land into residential for establishment of
“Housing Colony”.

“Favour of kind attention is invited to letter No.4066-83-


VI/3292-CS, dated 07-11-1983, the Board of Revenue, Punjab,
has been pleased to observe that the Evecuee land forming a
part of compensation pool was Central Government Property
and was allotted to refugee claimants. It is not governed by the
Colonization of the Govt. Lands Punjab act, 1912” (F/H)

“The Evacuee lands /sites transferred to the refugee clainabts


against their verified claims do not come within the purview of
Para- 550of the Colony Manula what-ever its origin may be. It
would be recalled that the evacuee lands were transferred to
the reefugee claimants as un-incumbered and un-conditional
grants by the Federal Government in lieu of lands abandoned
by them in India” (F/I)

11. In the circumstances of the case referred above, it is proposed that


No Objection Certificate may be issued in this respect, without charging of
Condonation fee according to information provided by the ADLR, as the
provisions of Para-550 of the Punjab Colony Manual is not applicable in the
instant case, after decision of applications under PUC-II & III, submitted by the
Mr. Amir Sattar and Mr. Hamza Yaqoob.

12. If agreed, the case may be submitted to the worthy District


Collector, Sahiwal for appropriate order.
