Mission and Vision

HPRP envisions an end to homelessness


in Maryland.

HPRP’s mission is to end homelessness in Maryland by


providing free legal services, including advice, counsel,
education, representation and advocacy, for low-income
persons who are homeless or at risk of homelessness.

Our staff and volunteers pursue this mission by


offering legal services through outreach in
shelters, soup kitchens, welfare offices, community
centers, and on the street. Our direct representation
informs broader-based systemic advocacy and impact
litigation to address the root causes of homelessness.

A Message From Our Leaders
Dear Friends:
Fiscal Year 2010 presented us with a reminder of the tremendous need for the work of
all homeless services providers, including the Homeless Persons Representation Project
(HPRP). In June 2010, the federal government reported that homelessness in Maryland
has increased 26%, demonstrating that the economic crisis has not relinquished its hold
on the most vulnerable members of our society. HPRP is equipped to respond to the
legal needs of this population to obtain basic life necessities, such as food, housing, and
income supports.
As you will read inside, HPRP built upon the goals established in its 2009 Strategic Plan
(available at www.hprplaw.org) to expand its ability to respond to rising homeless-
ness by increasing the number of volunteers providing pro bono legal service to HPRP
clients, raising and diversifying funding sources, and expanding advocacy efforts. During
the Fiscal Year, HPRP’s volunteer base increased from 188 to 309 attorneys, paralegals,
and law students; and its housing unit doubled with new federal funding for eviction
defense.
You will learn that HPRP devoted resources to help low-income families obtain
critical public benefits, including food stamps. In collaboration with the Public Justice
Center, Kirkland & Ellis LLP, and the National Center for Law and Economic Justice,
HPRP obtained a court order in December 2009, finding that the State of Maryland
Department of Human Resources had engaged in a pattern and practice of violating
federal and state laws regarding the timely distribution of public benefits, including food
stamps. HPRP staff and volunteers also recovered over $50,000 in back public benefit
awards for homeless and low-income families and individuals as part of their direct
representation efforts.
You will also read about HPRP’s Linda Kennedy Fellowship in Advocacy, a year-long
fellowship created in honor of the late Linda Kennedy, Esq. for a law student to pursue
systemic solutions to homelessness. Recognizing that domestic violence is the second
leading cause of family homelessness, the inaugural fellow and HPRP staff were part of
the Safe Homes Coalition which drafted and saw passage of legislation, sponsored by
Baltimore City Delegate Cheryl D. Glenn, to protect the housing rights of victims of
domestic violence and sexual assault.
Lastly, HPRP continued its efforts to diversify its funding sources. HPRP’s Second
Annual Campaign to End Homelessness successfully raised $71,245, with the generous
assistance of a dynamic Campaign Committee chaired by Arnold M. Weiner.

HPRP Pro Bono Program
HPRP could not have touched the lives of so many individuals this year
without its talented and dedicated volunteer lawyers, paralegals, law
students and others. In 2010, volunteers donated over 4092 hours of
service to HPRP and its clients, including over 3781 hours, valued at
$1,598,427, donated by attorneys.

In 2010, HPRP continued the strong development of its pro bono program. HPRP
increased its number of volunteers from 188 to 309. These volunteers opened
382 legal matters, an increase over the 371 matters opened by volunteers during
the previous fiscal year.

HPRP reorganized its Montgomery County intake program, refocusing legal


services on core issues affecting the root causes of homelessness and adding
expungement and veterans’ benefits representation to the services available at
the site.

sity of Baltimore School of Law, whose generous sponsorship helped to make

HPRP opened 618 cases and closed 511 cases. These


cases constitute matters in which HPRP staff or vol-
unteers represented people struggling with homeless-
ness in legal disputes to prevent or end homelessness.
HPRP also received 671 calls where brief advice,
information, or referral was given. These calls reflect
the “unmet” need because of insufficient resources or
other reasons.

HOUSING
As provided in Baltimore City’s 10-Year Plan to End Homelessness, The
Journey Home, “[l]egal representation for low-income renters is a key
strategy for preventing homelessness.” The 10-Year Plan set a goal of
expanding legal representation for persons at imminent risk of becoming
homeless and specifically identified HPRP as one such organization that
could aid in the effort. Therefore, consistent with the 10-Year Plan’s goals,
HPRP doubled its capacity to represent extremely low-income renters
facing loss of housing. HPRP, the Legal Aid Bureau, and the Public Justice
Center successfully collaborated on proposals for funding through the
Homeless Prevention and Rapid Rehousing Program of the U.S. Depart-
ment of Housing and Urban Development to provide a continuum of legal
services on eviction prevention in Baltimore City. HPRP’s role in the
collaboration is to provide direct representation to families and individuals
in subsidized housing facing eviction or subsidy loss.

ACCESS TO PUBLIC BENEFITS


HPRP Staff, in collaboration with co-counsel—the Public Justice
Center, the National Center for Law and Economic Justice, and Kirkland
& Ellis LLP—obtained an Order from the Circuit Court of Baltimore City
in December 2009 finding that Maryland State’s Department of Human
Resources (DHR) engaged in a pattern and practice of violating federal
and state laws regarding timely processing of applications for Food Stamps,
Temporary Aid to Needy Families (TANF), and Medicaid. The Court held
that DHR is required to achieve full compliance with federal and state
laws, which provide for processing of applications within 30 days, within 12
months.

VETERANS’ BENEFITS PROJECT


HPRP expanded its Veterans’ Benefits Project, Maryland’s only free legal
service program representing veterans in claims for U.S. Department of
Veterans Affairs benefits, to offer representation at its Montgomery
County intake location in addition to its Baltimore City locations. In
collaboration with the Veterans’ Affairs and Military Law Committee of
the Maryland State Bar Association, the Pro Bono Resource Center, and
the University of Maryland School of Law, HPRP also held the second
state-wide conference on veterans issues in Maryland on April 1, 2010 at
the University of Maryland School of Law with The Honorable Lawrence
B. Hagel, Judge, U.S. Court of Appeals for Veterans Claims, as the keynote
speaker.

Policy & Advocacy
Domestic violence is the second leading cause of family homelessness. To
reduce the number of victims of domestic violence who are evicted from
rental housing due to violence in the home and to limit the liability facing
victims who, for safety reasons, must leave their rental units mid-lease term,
HPRP was pleased to be a part of the Safe Homes Coalition, convened by
the University of Baltimore School of Law Civil Advocacy and Family Law
Clinics, which included domestic violence and housing advocates who wrote
and successfully urged passage of legislation before the General Assembly
that offers protection to victims of domestic violence and sexual assault in
housing. The legislation, which became effective October 1, 2010, provides
three levels of protection: 1) an eviction defense to protect victims from
eviction because of an incidence of domestic violence; 2) an early lease
termination provision; and 3) a lock change protocol.

On May 4, 2010, Governor Martin O’Malley signed into law


HB1382/SB554 Rental Housing - Protection for Victims of
Domestic Violence and Sexual Assault.

Representatives from the Safe Homes Coalition, which included organizations such
as the Maryland Network Against Domestic Violence, House of Ruth, Women’s Law
Center, HPRP, Legal Aid Bureau, and the Civic Advocacy and Family Law Clinics at the
University of Baltimore, joined the House bill’s sponsor and champion, Delegate Cheryl
D. Glenn, for the bill signing with Lieutenant Governor Anthony G. Brown, Senate
President Thomas V. Mike Miller, Jr., Governor Martin O’Malley, House Speaker Michael
E. Busch, and Senator Jennie M. Forehand.

Linda Kennedy Fellowship
The Linda Kennedy Fellowship in Advocacy
honors the late Linda Kennedy, Esq., a
courageous and determined advocate for
persons with disabilities and persons with-
out housing. Linda was a champion for equal
treatment of our clients and neighbors who
struggle with homelessness. Her tireless
work, particularly with people seeking to
overcome barriers to housing and employ-
ment imposed by criminal records, had a
significant impact in our community. Linda
provided critical representation to our
clients in their efforts to expunge arrest
records and resolve collateral issues related to criminal records. Linda’s
deeply caring manner with which she addressed the needs of each client
was special. The Linda Kennedy Fellowship in Advocacy provides a second
or third year law student with an internship at HPRP to work on policy
and systemic issues that promote an end to homelessness in Baltimore
City and in Maryland.

Ingrid Löfgren was a third year student at the
University of Maryland School of Law. Ingrid
represented HPRP in two coalitions
pursuing legislation before the 2010 Mary-
land General Assembly, including the Safe
Homes Coalition and a coalition of advocates
working on legislation to prohibit
discrimination against renters based on
source of income. She worked closely with
HPRP’s executive director, conducted
research to support legislative efforts,
attended negotiation sessions and presented oral and written testimony
on HPRP’s behalf in both the Senate and House of Delegates.
