Plaintiff filed the above captioned copyright action against multiple Doe
Defendants and immediately filed a motion for leave to take early discovery for the
purpose of identifying the defendants. Plaintiff then served a subpoena upon AT&T
Intemet Services requesting identifying information for the certain subscribers to whom
AT&T had assigned relevant ip addresses. Plaintiff's investigators had previouslyW

documented infringing activity occurring from the accounts identified by those ip
addresses.
On March 9, 2011 and individual filed a document which the Filer identified as a
Motion to Dismiss. The Filer only identified him/herself as Possible John Doe and
provided the e-mail addres:
sophisticatedjanedoe@yahoo.com, Plaintiff To Group, Inc.
Opposed the Motion and Moved to Strike.
Having considered the arguments and the papers filed in this action, the Court
HEREBY STRIKES, the document. Possible John Doe is not a party to this matter and
has no standing to file a motion to dismiss. If Plaintiff names the Filer as a Defendant, he
may file a Motion to Dismiss at that time.
Moreover, under Rule 11, parties may not file papers that are unsigned.
IT IS SO ORDERED.
