SUBJECT: Update Recommendationto Transfer to the Control of Another Country for
ContinuedDetention(TRCD) for GuantanamoDetainee,ISN: US9AF-000801DP(S)

For this updaterecommendation,detaineeis assessed as a probablefacilitator of Al-Qaida


membersand possibly a non-Taliban affiliated supporterof anti-coalition militants. Detainee
was a Brigadier General (equivalent) for the border guardsin the Afghanistan (AF) province
of Konar. He doesnot seemto have any loyalty to any particular group and had reportedly
been at odds with the Taliban for at least five years. He seemsto side with any group or
organizationthat is willing to pay or reward him for his cooperation,from coalition forces to
Arabs fleeing Afghanistan. Most of the information of intelligence value provided by
detaineeis in regardsto detainee'sconnectionsto Mullan Haji Rohullah,US9AF-00798DP
(ISN 798). Rohullah was a high-ranking member of the Jatna'atUl Dawa Al Qurani (JDQ).
The JDQ is an extremist Islamic organization with ties to various multi-national radical
Islamic groupsand the PakistaniInter-ServicesIntelligenceDirectorate(ISID). It is assessed
this detaineeis a MEDIUM risk, as he may posea threatto the US, its interestsand allies.

4. (S//NF) Detainee Background Summary: Unlessotherwisenoted,the following


paragraphsare basedsolely on the detainee'sstatements.

a. (S) Prior History: Detaineefought againstthe Russiansfrom 1981to 1995. From


1995to 2001 he was involved in the resistanceagainstthe Taliban in Konar Province,AF.

b. (S) Recruitment and Travel: After the fall of the Taliban,detaineewas given the
rank of Brigadier General and put in chargeof approximately 600 border security troops
along the Afghanistan (AF) /Pakistan (PK) border of Konar province, AF.

c. (S) Training and Activities: In November2001, while detaineewas the border guard
commander,Arabs who had fled the battle of Tora Bora arrived in Asadabad,AF in several
vehicles. Local tribal forces detainedthe Arabs. An argumentbegan betweenlocal tribal
leadersabout whether to turn the Arabs into coalition forces. A council of tribal elderswas
held to decidethe matter. The counseldecidedto seizethe vehiclesand allow the Arabs to
escapeto PK through detainee'sbordersof responsibility. The Arabs traveledto Pashad,AF
beforecrossinginto Pakistan.

d. (S) Gapture Information: On 22 August 2002,detaineewas capturedin Asadabad,


AF, while he attendeda meeting betweentwelve regional leadersand four US military
personnel. The meeting was held due to ongoing rocket attackson American troops.

f. (S//NF) Reasons for Transfer to JTF GTMO: To provide information on the


following:

o Afghanistan border security after the fall of the Taliban


o The Ullah family, specificallyRohullah (ISN 798)
o PakistaniInter-ServicesIntelligenceDirectorate(ISID) and their links to Al-Qaida
and Taliban
o Routes of ingressinto Afghanistan
o Routes of egressfrom Afghanistan

. (S) Detaineewas arresteddue to his suspectedinvolvementin ongoingrocket attacks

o (S/AIF) Detaineehas closeties with ISN 798. The following are ISN 798's activities
that took place in the Konar province while it was under detainee'sborder control:
o (S/A{F) ISN 798 was involved in smuggling Arabs and their families from Konar,
AF to Pakistansincethe 9/ll attackson the United States.ISN 798 typically worked
with detaineeto ensurethe Arabs were smuggledsecurely. Detaineeadmitted that
Arabs have crossedthe borders under his control.
. (S/AIF) From 15-16November 2001,Detaineeprovided securityfor nine
Arabs, two of whom were wounded, as they fled Tora Bora. The Arabs were
armed with two PK machine guns, two rocket propelled grenadelaunchers,and
six AK-47's. Detaineeassignedone of his team leaders,Amin Akhund, to
personally handle the security for the Arabs. Detaineearrangedfor the nine men
to be transferredto his fort in Wordish, AF where they awaited the arrival of ISN
798. When ISN 798 arrived, he provided detaineewith an unspecified amount of
money and instructionsto smugglethe Arabs into Pakistan. ISN 798 rewarded
detaineeby allowing him to keep the weaponsthe Arabs carried, as well as the
truck in which they traveled.
. (S/A{F) It is believed that an additional 65 Al-Qaida Arabs were brought from
various points in AF to Konar province, where detaineewas in chargeof the
borders in late 2001. The Arabs were then allegedly smuggledto Pakistanat the

unidentifi ed Wahabi party offi cials.
o (S) Detaineewas a former memberof ISN 798's Jarna'atUl Dawa Al Qurani
(JDQ), (Analyst note: The JDQ is a SalafistIslamic organizationwith ties to various
multi-national radical Islamic groups and the Pakistani Inter-ServicesIntelligence
Directorate(ISID))
o (S) Abdul Rahim Mannan,US9AF-000561(ISN 561), overhearddetaineeand
ISN 798 bragging about a time when the ISID sent a military unit into Afghanistan,
posing as civilians to fight along sidethe Taliban againstUS forces. After the ISID
units got captured,ISN 798 securedfunds from the ISID for their release.
. (S) ISN 561 hearda conversationbetweendetaineeand ISN 798 aboutISID's
protection of Al-Qaida membersat Pakistanairports. The ISID membersdiverted
Al-Qaida membersthrough unofficial channelsto avoid detection from officials
in searchof terrorists.
. (S) ISN 561 reportedthat detaineewas a JDQ commanderwho was put into
the Northem Alliance to spy on their activities.
. (S) Detaineeprovided information on routes that were used to smuggle lumber across
the border and admitted that those routes could be used to smuggleweapons.

c. (S/NF) Detainee's Conduct: Detainee'sbehaviorshowsnumerousincidentsof


failure to comply and harassingthe guards.
