On May 25, 2011, Plaintiff served the Summons and First Amended Complaint in this matter via certified mail with return receipt required on Defendants MARIUSZ PRALAT and MALGORZATA FRACZYK, each of whom reside outside the State of California. Sperlein Declaration at 2. Under California Code of Civil Procedure 415.40, service became complete ten days after mailing June 4, 2011. Defendants responsive pleading became due after an additional twenty-one days June 25, 2011, that date falling on a Saturday the responses became due on Monday, June 27, 2011. Defendants MARIUSZ PRALAT and MALGORZATA FRACZYK have not filed responsive pleadings in response to the First Amended Complaint. Id. at 4.

The above-stated facts are set forth in the accompanying declaration of Gill Sperlein, filed herewith.
