St. Luke Community Clinic fundraiser a success
The crowd mills over silent auction items and food before the live bidding began. Auctioneer Tom Eschelman and St. Lukes Director Glenn Burdick may be wondering how the bidding would go on the 1969 VW Bug Burdick put up for auction - it went well. By Carol Ballard Warren County Report Upstairs at the Front Royal Fire and Rescue Hall, supporters gathered last Saturday night for an evening of companionship and to bid on donated items at the annual benefit dinner and auction for the 15-year-old St. Luke Community Clinic. Im very pleased with the turnout for the auction and to see everyone enjoying the good food, said Executive Director Dr. Glenn Burdick. He noted that the Sept. 4 event was the first time it had been held inside and had the highest attendance since the fundraisers began. Folks crowded around tables where a huge variety of items were displayed for silent bidding. For the live auction, several local artists donated paintings and sculptures and others donated active participation treats like paid date nights at restaurants or golfing and ski days and passes to Disney World. The top donated item was an antique 1969 Volkswagen Beetle convertible, lovingly restored by Dr. Burdick, who bought it in the 1990s and painted it Tornado Red. It brought in his asking price at $5,000 and now belongs to Raymond Heflin and his family. Im pleased it went to a young family with children who I know will enjoy it, said Burdick. Other items were displayed and the evening, according to Glenn, was a huge success. He was estimating that the 175 people who participated would help to bring in the $8-30,000 St. Luke needs for general operating expenses. They did that and more. The total raised at the live auction was $10,000 and overall $37,000 was raised for the clinic. For those not familiar with St. Luke Community Clinic, it is located at 316 N. Royal Ave. and provides free medical care and discounted or free prescription medication for eligible adult Warren County residents, aged 18 to 64 who have no health insurance. One stipulation is that the total family income must be less than 00 per cent of the Federal Poverty Level. Grateful clients at St. Luke have responded with these answers to a routine question: What would you do for health care if St. Luke Community Clinic did not exist? Nothing. I would probably have to suffer until I couldnt anymore, wrote one. At this point in my life I would probably go into a diabetic coma. I would be lost, replied another. Burdick added that the clinic can use more volunteers. In addition to doctors and nurses, they need screeners who will interview people for eligibility. Also needed are people to do office work, prepare meals, help with grounds keeping and maintain the building. Wayside needs $4,000 two weeks from deadline

Survival of Valleys oldest regional theater still on the edge
By Malcolm Barr Warren County Report In the next two weeks Wayside Theatre will reach for the final $4,000 needed to acquire its financial goal of $90,000 to avoid bankruptcy. Meanwhile, an announcement is expected fairly soon on the historic theaters future. The board of directors, headed by John Westervelt of White Post, and theater staff are busy examining a number of options on how to move Wayside Theatre forward if bankruptcy is averted. The public input, donor and readers support have been key factors as weve gone through this process, said Warner Crocker, the theaters artistic director. You can say we are very close to getting through this cash-flow plunge ... weve solved the immediate crisis ... the planning now is for the best and most effective way of moving ahead in the future. The board met in regular session on Sept. 0, and meets again in special session next week. Crocker said he hoped those who havent yet joined those fighting for Wayside Theatre will want to jump in during these final days to help us go over the top. Contributions may be made by calling the box office at 540-869-1776 (at the same time, buying a seat for our next show will also help, Crocker said), mailing a check to Wayside Theatre, PO Box 60, Middletown VA 645, or visiting the theaters website and sending in a donation via Pay Pal. Two upcoming events dedicated to the funds drive are the Annual Classy Trash Sale, Saturday, October 1, from 7:30 a.m. to 1:30 p.m. at the theater building in Middletown. The same night, at 8 p.m., the noted psychic, Michael Brooker, will present a Psychic Gallery Reading to benefit the emergency campaign. The next production, starting October 8, is the spine tingling ghost story, The Woman in Black.

Town authorizes $1.5 million toward purchase of BB&T building
6, council approved Napiers appointment by a 5-0 vote (Conkey absent). Napier has been practicing privately in the law firm of Pond, Athey, Athey & Pond after resigning his position as Warren County Attorney in 006. Napier will take his new position on Nov. 1. In the interim, Assistant Town Attorney George Sonnett will continue as Acting Town Attorney before reassuming his old position. Sonnett was one of several unsuccessful candidates for the town attorney job. In the end it appears Napiers past experience heading a municipal attorneys office gave him the nod. Mayor Tim Darr confirmed experience as one deciding factor in councils decision. A town press release pointed out Napier brings over 5 years of local government experience to the town.
Bank building in distress? - not if the towns bid is accepted. By Roger Bianchini Warren County Report About five years after Blair Mitchell moved across town to take the job of county attorney replacing Doug Napier, Napier has moved a shorter distance from the Pond, Athey, Athey & Pond law offices across the street into town hall to take Mitchells old job as town attorney. It may not rival blockbuster sports trades or be a trade at all but a municipal government fantasy league website indicates a direct Mitchell for Napier trade was held up in 006 by a disagreement over the number of draft picks that would have accompanied one of the players across town (kidding folks dont look for that website, it doesnt exist). Mitchell raised eyebrows when he resigned as town attorney during a high-turnover period among town staff (particularly town manager, four interim, acting or permanent within two years) to move into what at least appeared to be a more stable county government environment. Not that things have been all that stable around town hall lately, with four department heads leaving within a year of the firing of Town Manager Michael Graham; three of whom IT, attorney and planning director left within two months of each other this summer. But at least the town now has its top two administrative positions, manager and attorney, filled without the words acting or interim prefacing them. Mitchells January 007 move across town came after Napiers unexpected resignation as county attorney several months earlier. Napier resigned shortly after the firing of then county Human Resources Director Anita Mabie. But unlike on the town side at the time, the staff dominoes ceased tumbling in the WCGC after just two departures. Following a closed session on Sept.

We asked Napier about his move back into municipal government after almost five years in private practice. Im looking forward to it. I think the town has assembled a good staff that is dedicated and professional and I look forward to working with them. Conspiracy? As for a mass-circulated e-mail alleging a good ole boy conspiracy installing the past county and Pond, Athey, Athey, Pond attorney in town hall, Napier said, I dont known anything about a good ole boy conspiracy. Id like to think I was appointed on merit Ive lived and practiced law here all my life. The town press release noted, Mr. Napier is a life-long resident of Front Royal and a graduate of Virginia Tech and Wake Forrest University School of Law Mr. Napier resides in Front Royal with his wife Kathy and has three children Brian, Adam, and Brooke as well as a grandson. Well, for some we guess that is the definition of being a good ole boy you are a lifelong local; you know a lot of people; so consequently you can have no professional ethics. But as with other past accusatory e-mails and statements from the source of the referenced e-mail, it is light on factual support but heavy on theory in forwarding its obsessively long, rambling, jailhouse lawyer-styled discourse. BB&T purchase Following the Sept. 6 closed session the town also authorized $1.5 million toward the purchase of the BB&T Bank building at 10 East Main Street. After BB&T announced its intention to leave the building in order to relocate to a new building under construction in the 5 North Commercial Corridor in Warren County, the town was facing the potential that the first two major buildings at the head of East Main would be empty the other is the longfloundering Afton Inn. However following the Sept. 6 funding approval, the town is in the process of negotiating the purchase of the building for $1,5,000 from BB&T. The balance between that amount and the $1.5 million figure would be for renovations and associated costs. If the purchase is made, a loan payment would be made over a 10-year period, according to the motion read into the record by Councilman Parker. On Sept. 8 Town Manager Steve Burke confirmed the town had made its offer and a contract was under legal review by both parties. Burke also confirmed the towns intention is to relocate and consolidate its administrative offices to the 10 East Main street location. That means town
staff from both town hall and the business building the finance department shares with Comcast Cable on North Royal Avenue would relocate into one location. Burke said the town currently has no plan to sell the current town hall but would consider its options with the business building where citizens can now make utility payments directly to finance department staff, and where Comcasts business office is. Perhaps ironically, the authorization to move on the BB&T purchase came not long after former Mayor Stan Brooks asked the town consider keeping the BB&T building as a private-sector business building, rather than municipal office space if it did follow through on a purchase. Brooks told council he believed as much as $50,000 to $75,000 in tax and other revenues could be lost by converting the building to public use. He questioned a potential negative effect on the commercial vibrancy of a downtown business district already struggling with county corridor competition and hard economic times for small businesses everywhere. I understand the impetus to buy it - but, Brooks said of the tax and commercial implications of a straight conversion to municipal ownership and use. He suggested if purchased, the town work with the Economic Development Authority to re-develop the building into another commercial use that would contribute to historic downtowns place as a thriving business center for the community. But alas, the opportunity was too much to pass up for a town government feeling the squeeze of staff space needs already sprawled into two locations. Again the vote was 50.
Engles Angle: The Rule

By Kevin S. Engle Warren County Report Friday. Noon. Can I come home now? I was pleading. No! You have errands to do. Get those done and well talk about it. My wife can be a real taskmaster. But I want to come home. Not yet. Ill tell you when its safe. One of my favorite times of the week is Friday at lunchtime. Thats when I walk out the door at work and start my weekend. But not today. Today is not a regular Friday. Today a contractor is coming to the house to fix some things. And while thats going on, Im banned from the premises. Why? Because Im a neat freak. When I see ladders in the house, I freak out. I dont have anything against ladders, but theyre dirty. I dont like dirt. Not in the house anyway. At our place, we have one big rule. No shoes upstairs. I dont care if the President of the United States pops in for a surprise visit. Those shoes are coming off. Even if I have to wrestle a few Secret Service guys to make it happen. Not only do the shoes come off, I want you to take them off in a certain place. At the BOTTOM of the basement stairs. Not when you walk in the basement. Not when youre standing outside. At the BOTTOM of the stairs. Got it? When someone doesnt follow The Rule, I freak out. Sweat runs down my arms while I fixate on the offender s footwear. I cant help it. Its in my DNA. The good news is Mr. Contractor has been here before. He knows all about The Rule and is good at following it. The bad news? Hes bringing a ladder. Halfway through my errands, I call home. Is he there yet? No, hes not coming until tomorrow morning. He got a late start. Alls clear. Saturday. 8AM. my neighbors lawns as well. Whatever it takes. Noon. Im done. Hes not. Im hungry. My wife and I eat lunch in the basement. Thats as far as Im allowed to go. A short while later, as Im pulling weeds, I see something that almost puts me into cardiac arrest. Mr. Contractor steps out on to the porch. The dirty porch. In his socks. And then he goes back inside. In his socks. A quick recap. Inside. Clean. Outside. Dirty. You dont mix the two. Ahhhhhhhhhhhhhhhhhhh!!! Mid-afternoon. Im quickly running out of energy, and enthusiasm. Theres more I could do, but I dont feel like it. Mr. Contractor still hasnt finished. And now hes off to the store to get stuff he needs to complete the job. A thought crosses my mind. Why not go in and head straight for the shower? That sounds like a good idea. But its not. In fact, its a really bad idea. Id see furniture moved, other stuff out of place, and of course, ladders. I cant do it. I dont do it. Id have nightmares for sure. I hop on the exercise bike in the basement and go for a spin. Im too tired to ride, but Im running out of ideas. 5PM Mr. Contractor returns from the store and finishes the job. As soon as hes gone, Im upstairs. A quick inspection and everything seems to be ok. All is right with the world. The next day, my wife mentions some other inside projects shed like done. Projects that require a ladder. Shes obviously not thinking clearly. I need time to recover first. We can talk about it next year. Or not. The White House called the other day. Seems that a certain someone wants to pay us a visit. Hed better have clean socks. kevinengle456@comcast.net

The program has been in existence since 1997, servicing municipal, corporate and individual clients, including in more urbanized and suburbanized areas to our east. Representatives said the program currently has about 400 clients and a 94-percent recovery rate for deer targeted in the program. Stats presented included 615 kills in 010 and 1,659 from 007 to 010. Of those killed deer, 44 percent have been donated to charity to be butchered and distributed to needy families in the area in which they are taken. Another 37 percent have gone to private use. All authorized hunting must be done from elevated stands. Arrows used are marked and are traceable to individual bow hunters authorized for the program. With restrictions and oversight by state and local officials, the programs design is not to take shots in situations where homes or individuals would be in jeopardy While the goal is to always take a fatal shot through both lungs, deer may travel 50 to 60 yards before falling even with successful kill shots. We will wound deer, a program rep told council, but we have damage control teams and a dog team to track wounded deer people often dont even know were there. After noting that public hunting is not a practical or safe solution in towns, Keller told council, This is the safest way [to deal with deer overpopulation in town limits]. The problem wont go away were seeing more moving in here. I think this is our best bet in the long run. We do have a deer problem. Why do I feel like someones watching me? - Photo by Warren Brown By Roger Bianchini Warren County Report A proposal to use bow hunters to reduce the population of native whitetail deer utilizing properties within the Front Royal town limits as part of their habitat is under consideration by the town council. Town Police Lt. Clint Keller introduced representatives of involved organizations and public officials who oversee and sanction such operations elsewhere in the commonwealth to a town council work session on Sept. 19. In addition to Lt. Keller, himself a bow hunting enthusiast and supporter of the program, addressing council at the work session were Fred Frenzel, a game biologist for the Virginia Department of Game & Inland Fisheries, Whitney Wagoner of the Suburban Whitetail Management Program of Northern Virginia, and Wade Colton, president of the Massanutten Archery Club. Speakers stressed that the program does not enable public hunting within town limits, but rather initiates a strictly supervised program manned

In addition to more rural subdivisions with adequate spacing between homes, typical hunting sites described included sprawling corporate grounds and landfills where special ops hunting methods are utilized. Carson Lauder said he was satisfied with the safety standards described and thought harvesting deer under supervised standards was preferential to seeing the deer population ravaged by diseases associated with overpopulation or lying on the side of the road dying from collisions with cars. Shae Parker asked what town ordinance changes would be necessary to enable the programs implementa-

Acting Town Attorney George Sonnett said that with the program authorized at the state level and the local code acknowledging legal parameters locally or as otherwise authorized by state law it wasnt clear that a code change would be required. However Sonnett added that there could be some lingering liability issues the town would want to address by code. After thanking Keller for organizing the presentation, Tom Conkey said his major concern would be anything allowing uncontrolled hunting, adding his belief that this organization got its act together in presenting a viable alternative. In response to a question from Tom Sayre, organizers said there was no associated cost to landowners for allowing the program on their property. Darr suggested council review the program further with staff and bring the matter back to a second work session before making a final decision. One potential variable council may keep an eye on is public reaction. One deer culling program rep said, We try to be as transparent as possible. However he added that he would never go on TV again to explain the program in the wake of some unpleasant phone calls he got in response to a past appearance. There are anti-hunting elements out there, he pointed out. And apparently despite strict safety standards and the potential of vehicle collisons and diseased herds from uncontrolled overpopulation, the notion of bringing down Bambi doesnt sit well with that element.

Town re-releases bear strategies

The Town of Front Royal is surrounded by forested lands and parks inhabited by Virginia black bears. Bear are highly adaptable and can identify food sources based upon smell. Black bears can seek food sources in residential areas at any time of year, but are more common when natural food supplies are limited or when they have associated human dwellings with food. The most common food sources for bears in residential areas include bird feeders, garbage cans, pet food, compost piles, and grills. The Virginia Department of Game and Inland Fisheries offers the following suggestions to prevent nuisance bear problems: Secure your garbage in a shed or garage, or within a bear-resistant container; Put you garbage out in the morning for collection, as bears are nocturnal; Remove your bird feeder, as bears consume seeds and nuts in the wild; Pick up your pet food if left outdoors; Clean your grill often; Dont put meat scraps or strong-smelling food in the compost pile. If you experience bears scavenging through your Town issued garbage container, please contact the Towns Public Works Department at (540) 635-7819 to report this problem. Our staff can retrofit your container to be bear-resistant. The Virginia Department of Game and Inland Fisheries offers more information about coexisting with bears at http://www.dgif.virginia.gov/ wildlife/bear/. Artist Kunstler, former Army head Marsh featured at 175th event

Warren Countys 175th Anniversary Planning Committee and the Warren County Judiciary will celebrate the Commemoration of the 75th Anniversary of the Warren County Courthouse and the unveiling of ON TO THE SHENANDOAH by renowned Artist Mort Kunstler. Ceremonies will commence at 11:30 AM on Saturday, Oct. 8 at the historic courthouse at the corner of Main Street and Royal Avenue. The courthouse will
open for tours at 11 AM, prior to start of official ceremonies. The painting features the original courthouse with General Jackson in the foreground. The original courthouse was completed and occupied in 1838. It was a red brick building 60x3 feet and constructed at a cost of

Sam Parsons celebrates his 100th birthday

Two years after retiring from Martins, Sam is still planting in the spring
house late one night. The calf slept in the bathtub until the next morning where it was presented to Sam at his farm. Sam took her in and raised her as his own. When he retired from Avtex in 1973, he wasnt through working yet and hired on at Harmony Hollow Orchard where he made good use of his farming experience. Years later, he again wasnt content to just sit back, and went to work for Martins in 1996. Ask anyone who saw him there bagging groceries and always giving out a sweet, cheerful smile how much he added to the grocery store. And he didnt want to leave even when he had to. I would still be working at Martins if I hadnt lost my eyesight two-anda-half years ago, he said. Since 1911, the world has gone through huge changes, and one man is here to say that he has enjoyed living through all of them and he enjoyed his party. He was so happy and keyed up, he stayed up until midnight afterwards talking about it, said Patsy. Its been a happy life and I still put in tomatoes this spring, he said.

By Carol Ballard Warren County Report Stewart Sam Parsons sat sweetly smiling at his birthday celebration, on the 4th of September, a week and a day after he turned 100 years old. Ive enjoyed it, but if not for the Good Lord and his Son, I wouldnt be here today, he said. He was wearing a cheerful red shirt, enjoying the attention and praise of family and friends and eating ice cream with his favorite yellow birthday cake. Patsy, his wife of 17 years had the idea to give him a celebration at the Rivermont Baptist Church, where they met. She got things going a few weeks ahead of time by putting out the word that anyone who knew him and wanted to give him a birthday card, could bring it to Martins Food Market in Front Royal. Since he only retired from there at a still-active 98, there were a lot of people who not only remembered him, but remembered him kindly. He got 35 cards, she said. Family from far parts of West Virginia who hadnt seen each other or him for a while got to visit and gathered around where he was sitting. They leaned across the table to wish him happy birthday and talk over old times and tell stories of their own.
They attributed his longevity to a life of clean living and hard work. He never smoked or drank - well, just water - and wouldnt even drink soda or coffee, wouldnt take anything into his body that would harm it, said his nephew Bob Parsons. Bobs wife Barbara noted that he had inspired them to become involved in the church. I never saw him lose his temper, and he never said a mean word to anyone either, she said. They presented him with a Living Legend T-shirt for the occasion. His physician Dr. Guna Subedi from Front Royal also came to show his respects. He just loves him a lot and came by to say Hi and Happy Birthday. It was a very sweet thing for him to do, said Patsy. Since the church was a big part of his life, it was fitting that the party be held in the original building across the street from the present chapel where he was on hand to lay the first brick and be involved in its construction. As for the working part, Sam never stopped until he had to. In 199 as a teenager, he was hired on at the American Viscose plant in Parkersburg, West Virginia. It was hard work and I had big wages, made cents an hour to start! he said with a laugh. He ended up working for the com-
pany, which was later known as Avtex in Front Royal, for 45 years and moved to Front Royal in 1940 to work at the plant here. Sams son James noted that he was one year old when his dad made that move. James (Jimmy) said that his dad was a lead burner whose job it was to maintain and repair any tanks made
of lead so they wouldnt leak acid. During the 1950s, he bought a farm in Waterlick and stayed close to his farming roots. Bob told the story of an orphan calf to illustrate what kind of a good nature Sam had. He said that a co-worker had bought a calf accidentally at a livestock auction and carried it in his arms to Bobs

Discipline of members supporting Dem nominee likely slow to develop
By Roger Bianchini Warren County Report They say theres nothing like the wrath of a scorned lover, especially one blindsided by that scorn perhaps there is a political analogy here somewhere. With controversy swirling around former Republican and current Front Royal Vice-Mayor Chris Holloways late summer jump from the Warren County Republican Committee to the Warren County Democratic Committee you had a gamut of reactions from wrath to confusion. Those initial reactions came from blindsided Democrats unhappy over Holloways taking of their caucus nomination from incumbent Glenn White, as well as from three prominent local Republicans who had assumed Holloway would run under their Partys banner. To summarize those reactions Dems are collectively unhappy; and Republicans Clay Athey, Matt Tederick and Tony Carter are confused about Holloways decision to switch political alliances for his run for office. Now after a slight delay due to his schedule and dealing with personal health issues, we have added another reaction from the scorned side of the equation Warren County Republican Committee Chairman Dave Henderson. Henderson, like the above trio of Republicans, said he was baffled by Holloways political move as well. However beyond that confusion, Henderson said he was appalled at Holloways actions as a newly-declared Democrat. Dirty politics You can quote me on this, the Republican chairman said, As for what Chris Holloway did to Glenn White I think it was dirty politics. He blindsided Glenn and the Democrats. Its not fair. I dont play those kinds of games in elections. Henderson said he knows White and his family personally and despite any political differences, I like him as a person. Does it complicate his efforts as committee chairman to organize a campaign for a Republican nominee, Dan Murray, now facing opposition from a recent Republican Committee member with at least some apparent in-committee support? What Im seeing is that people dont like dirty pool and politicians who play dirty pool end up losing, Henderson said. We asked Holloway if he wanted to respond to Hendersons comments. He said that rather than continue a he said/she said on the issue of his Party-hopping candidacy, he would stand by his past statements on that candidacy. Party not important As reported in our Aug. 19 issue, Holloway initially told us, Im not a hardcore Party guy Im tired of politicians putting the Party first; its time they put the people first and thats why Im running for supervisor, its that simple I hope to win this campaign not because theres a D beside my name but because I worked harder than my opponent and earned every vote. After finding these quotes he has elected to stand by, we asked Holloway with Party affiliation being so secondary to his candidacy, why he didnt run as an independent?

During our lag time in reaching Henderson we spoke to one current Republican Committee member and fellow Holloway town councilman, Hollis Tharpe. Responding to an e-mail request for a reaction to Holloways Party shift and unexpected run as a Democrat for county office, in an Aug. 5 phone conversation Tharpe told us he sup-
ported Holloways run for the North River seat and was sure the vice mayor would do a good job as a county supervisor. We asked Tharpe if he was still a Republican Committee member. Still a Republican member he assured us, if not a regular attendee at recent committee meetings. Recalling an ugly in-house stink several years earlier when a sitting committee vice chair (Tom Sayre) resigned amidst allegations he was supporting a non-Republican, ironically Democrat Glenn White against then

Henderson said to his understanding one such petition was being circulated by membership and that Hollis Tharpe was the sole target of that action. Had he been lobbied to hold off on such action until after the election? No, rather he said the dynamics of the process dictated a likely time schedule. What people dont understand is exactly how cumbersome the process is. It requires that one-third of the active membership, those who have not missed three consecutive meetings, sign a petition to bring the
action forward. Then it must be on the table for 30 days before we can act on it. Then a vote of two-thirds of those present would be required to officially remove the person from the committee, Henderson explained. Motive? As for a possible explanation of Holloways abrupt change of Party affiliations and move on his new Partys nomination against a sitting Democratic incumbent, Henderson said, Its just a strange situation. Thats the $64 question why didnt he run for the Republican nomination? Prominent local Republicans Athey, Tederick and Carter all said they had been aware for a number of months that Holloway was pondering a North River run for county office but had assumed it would be as a Republican. Henderson said that no, Holloway had not filed for the Republican nomination for North River supervisor. Im running as an independent and on my record as a Warren County Planning Commissioner, Victor Tory Failmezger said. Murray said he was focusing on his campaign, not on those who had made their mind up to vote for others. However he did add, Thats America people can support who they want. Relatively speaking Thrust to the center of the controversy by his longtime Party and committee affiliation and the fact he and Holloway are cousins, Happy Creek Supervisor Tony Carter told us in response to a question about the North River race and who he supports, As a member of the Republican Committee, I support all the Republican candidates. As you are aware Chris is my cousin. Having lived here all my life, as most people who were born and raised here, I am related either by blood or marriage, to many people. As far as Chris is concerned, I dont believe that my being his cousin helps him get elected, in fact it may actually hurt him in some circles. Neither do I think that my support of Mr. Murray will get him elected. The winner of this race or for that matter any race is the one who works the hardest and appeals to the majority of the voters. Back in the spring I did try to get Chris to seek the Republican nomination and for whatever reason he did not. The bottom line is I am a Republican and Mr. Holloway is family. The last thing that I will do is create a rift within my family. I saw this happen several years ago over the Walmart issue with two cousins on opposite sides and the devastating effects it had on their family. It is just not worth it. Fifteen students at Warren County High School have earned AP Scholar Awards in recognition of their exceptional achievement on AP Exams. The College Boards Advanced Placement Program (AP) provides willing and academically prepared students with the opportunity to take rigorous collegelevel courses while still in high school, and to earn college credit, advanced placement, or both for successful performance on the AP Exams. About 18 percent of the more than 1.9 million students worldwide who took AP Exams performed at a sufficiently high level to also earn an AP Scholar Award. The College Board recognizes several levels of achievement based on students performance on AP Exams. At Warren County High School: One student qualified for the AP Scholar with Distinction Award by earning an average score of at least 3.5 on all AP Exams taken, and scores of 3 or higher on five or more of these exams. This student is Darren Daniels. Four students qualified for the AP Scholar with Honor Award by earning an average score of at least 3.5 on all AP Exams taken, and scores of 3 or higher on four or more of these exams. These students are Moriah Bacon, Jeremy Vogt, Cody Zimmerman, and Cory Zimmerman. Ten students qualified for the AP Scholar Award by completing three or more AP Exams with scores of 3 or higher. The AP Scholars are Aaron Bridges, Leanna Eisenman, Ryan Molka, Kristen Moore, Emily Morton, Ashley Most, Michelle Polski, Timothy Pressler, Brooke Rutherford, and Logan Steinbach. Of this years award recipients at Warren County High School, four are juniors: Moriah Bacon, Leanna Eisenman, Emily Morton, and Brooke Rutherford. These students have at least one more year in which to complete college-level work and possibly earn a higher-level AP Scholar Award. Through 34 different college-level courses and exams, AP provides willing and academically prepared students with the opportunity to earn college credit or advanced placement and stand out in the college admission process. Each exam is developed by a committee of college and university faculty and AP teachers, ensuring that AP Exams are aligned with the same high standards expected by college faculty at some of the nations leading liberal arts and research institutions. More than 3,800 colleges and universities annually receive AP scores. Most four-year colleges in the United States provide credit and/or advanced placement for qualifying exam scores. Research consistently shows that AP students who score a 3 or higher on AP Exams (based on a scale from 1 to 5, with 5 being the highest) typically experience greater academic success in college and have higher college graduation rates than students who do not participate in AP. Down Syndrome Association Hosts 7th Annual Buddy Walk

The Buddy Walk was developed by DSANVs national affiliate, the National Down Syndrome Society, in 1995 to bring together individuals with Down syndrome, their families, and allies in an effort to promote awareness and to raise funds for education, research, and advocacy programs. DSANV hosts Northern Virginia s annual Buddy Walk, which includes a one-mile walk followed by a day of family-friendly activities and entertainment. This years event will feature a live performance by Rachel Coleman, the popular childrens entertainer who co-founded Signing Time an entertaining DVD series for children and families that teaches basic American Sign Language vocabulary in a fun and engaging way. Other activities and entertainment will include bounce houses, climbing walls, mini golf, petting zoo, pony rides, and childrens characters. Last year, the Buddy Walk attracted over 1,500 people and raised over $00,000 to support individuals with Down syndrome and their families. The money from the Buddy Walk serves as the sole source of annual funding for DSANV as it works to raise awareness of Down syndrome and provide important services to the community. DSANVs programs and services include The Learning Program, job seminars, and various scholarships and grants for continuing education.

Valley talent coming home for Browntown concert

On Friday evening, Oct. 7 at 7:30 PM at the Browntown Community Center, there will be a concert of fabulous feel-good music from the singer/songwriting team of J.D. Martin and Jan Garrett. J.D. Martin was raised in Harrisonburg, and this is a rare opportunity to hear him locally, as he is here to visit family, but lives in Colorado with his wife and musical partner Jan Garrett. J.D. worked as a staff songwriter in Nashville for many years, and has had hits recorded by many famous country stars (see the attached flyer for more information). Jan has toured nationally with John Denver and Steve Martin. Town authorizes mo money for Leachs Run Parkway

Sayre discloses personal interest declares fair and balanced stance
By Roger Bianchini Warren County Report While it was in a gregarious, post-closed session spending mood on Sept. 6 (see related story on BB&T bid), council also authorized additional funds for three more right-of-way purchases by the EDA for the proposed north-south connector road, Leachs Run Parkway. As councilman Shae Parker commented after making the motions on the allotments for the ROW purchases, with a number of earlier ROW acquisition moves, it seems movement toward construction of the long-discussed connector road between John Marshall Highway and Happy Creek and Shenandoah Shores Roads finally appears to be on a fast track. Appropriations approved by 5-0 votes (Conkey absent) approved, included $460,000 and associated costs for the purchase of house and three tax-map parcels at 1433 Happy Creek Road totaling about 4 acres owned by Raymond McDonald; and $300,000 for four taxmap parcels totaling 3.5 acres off John Marshall Highway owned by NVA Properties. Also approved by council was continued funding of the EDAs capital expense budget according to the terms of the Town County Fair Funding Formula whereby the Town currently funds approximately 1/3 (34%) of the EDA debt service through an annual appropriation and expenditure from the Towns adopted budget. According to EDA Executive Director Jennifer McDonald, with the current appropriations approved by both the town and county, a total of six properties at a cumulative price of $,490,000 have been authorized for Leachs Run Parkway ROW acquisition. Monthly payments on those acquisitions total $15,079. Other involved properties are Chris Ramseys 15 acres purchased for $1.075 million; 14.5 acres at 1497 Happy Creek Road owned by NVA Properties for $410,000; one acre at 145 Happy Creek Road owned by Mary and Timothy Chappell for $00,000; and about a half acre at 1110 Ewell Street owned by Ronnie and Ellie Benson for $45,000. Prior to the vote, Councilman Tom Sayre disclosed his personal interest in the Leachs Run Parkway ROW acquisition but said since more than three property owners are impacted and based on a past opinions by Commonwealths Attorney Brian Madden on an earlier potential conflict issues involving his property and a proposed roads he could vote and remain fair and impartial on the ROW appropriations. According to maps we have seen the proposed path of Leachs Run Parkway it is slated to take 4.9 acres of Sayres 45.6-acre home property. While having expressed past opposition to development in the area and the associated road networks proposed to facilitate that development, Sayre stated on Sept. 6 that most people in the area appeared to favor development of Leachs Run Parkway. He also said he now favors that the road be built at four lanes, rather than two. The councilman did not reply to our inquiry on the relative value of ROW acquisition from his property at either two or four lanes.

abandonment and adultery. Not surprisingly, the alleged adultery has been committed with Journey guitarist Neal Schon. In fact, one attached exhibit to the divorce filing in Warren County Circuit Court is an alleged e-mail photo attachment of male private parts coming from the source email schonamatic@yahoo.com Mr. Salahi states his wife of nearly eight years abandoned their Warren County home on or about Sept. 13, 011. According to a Warren County Sheriff s Office press release of Wednesday, Sept. 14, Tareq Salahi reported his wife missing and possibly abducted shortly before midnight on Sept. 13. As reported in our last issue, Warren County Sheriff s Office Deputy Mike Glavis reached Michaele Salahi within an hour of Tareqs 11:50 PM call and were informed she had left the residence with a good friend and was where she wanted to be and that she did not wish her husband to know her whereabouts. Within a day not only Tareq, but tabloid nation would know the circumstance of Michaeles departure and rendezvous with the rock guitarist at a Journey tour stop in Memphis. Videos of the couple, reported by the bands publicist to be dating for some time, were soon posted on Michaeles Facebook site and circulating nationally on TMZ among other tabloid news sites (even ours). Tareq requests the court grant him divorce, exclusive use of the couples home in Mosby Estates near Linden, that the conditions of a Premarital Agreement be honored, and that his wife not be allowed to disperse her personal estate pending any court decree related to the divorce. One, the other or both of the Salahis, or their attorney have been regulars in the Warren County Courthouse since their publicity coup surrounding an appearance at a Nov. 4, 009 White House State Dinner for the Indian delegation to the United States. No charges from financial audit of Farms fire dept.

State police continue investigation of gas and cash theft allegations
By Roger Bianchini Warren County Report On Sept. , Suzanne Maekall Perka, the Commonwealths Attorney for Clarke County, released a statement concerning the result of an audit of the Shenandoah Farms Volunteer Fire Department. That release stated in its entirety: My Office was requested to review if any criminal charges were merited as a result of an audit of the Shenandoah Farms Volunteer Fire Department (SFVFD). In connection with that request, the Virginia State Police assisted me in determining if certain concerns highlighted in the audit were criminal or rather reflected inadequate operational practices. Some of the concerns outlined in the audit were as follows: at one time there were approximately 14 debit cards in use or shared; alterations made to the SFVFD Quickbooks; there were estimated to be 1 to 14 master keys; checks written for Cash; and receipts were missing. The SFVFD is a volunteer organization and as such does not have a professional staff maintaining its books. With this in mind, irregularities in an audit do not necessarily mean there is criminal activity. The concerns outlined in the audit are, in my view and the State Police, a reflection of the casual manner in which the accounting was handled, and certainly, with that kind of atmosphere, proving any criminal activity such as embezzlement is

After review of this matter, I have concluded that to avoid the appearance of impropriety and to safeguard their property SFVFD should take appropriate measures to improve its accounting and operational practices but that no criminal charges would result from this audit. The Clarke County Sheriff s Office is still investigating the theft of cash and gasoline from SFVFD. Those criminal investigations will continue. Warren County Administrator Doug Stanley responded to Perkas press release: I have read the press release from Ms. Perka, the Clarke County Commonwealth Attorney. While their review of the audit of the Shenandoah Farms Volunteer Fire Department (SFVFD) did not uncover any irregularities that would warrant criminal charges at this time, we remain concerned with the general lack of oversight and management of the Departments finances and operations. This includes both the taxpayer contributions of Clarke and Warren Counties and the funds raised through their fundraising activities. We are also extremely concerned about the allegations of theft from the station that are currently be investigated. We will be working with Clarke County to develop a path forward and possibly procedures to determine the level of oversight that we would like to put in place to ensure improvement to the accounting and operational practices of the department to a level that we are comfortable with and that will pro-

tect and safeguard the publics investment in the fire company. One thing is clear changes need to occur in how the finances, both public taxpayer contributions and private donations/fundraising are handled to restore the public trust. We look forward to working with SFVFD and Chief Cook in moving forward. Where theres smoke The impetus for the investigation were concerns expressed by a Farms resident with certified firefighting background who had direct experience with what he believed were unsound operational methods and decision-making processes at SFVFD. During the April 19 Warren County Board of Supervisors meeting Matthew Krysler summarized his concerns and asked further funding of the department be withheld pending an investigation. According to county minutes of that meeting, concerns expressed by Krylser, which he also presented to Clarke County officials, included: Possession of three years of financial records that showed the

On September at approximately 3 PM, the Warren County Sheriff s Office received a call of suspicious persons in the area of the Linden Park and Ride on Dismal Hollow Road. An observant resident in the area had reported seeing a black male wearing a red shirt and a black male wearing a white collared shirt enter the lot in a maroon Honda, park the vehicle and leave the area on foot with each person going in different directions as if running from someone. Deputies arrived on scene and checked the area but were unable to locate the persons. The vehicle was located and after some investigations was found to have been stolen from Fairfax County. While continuing the investigation, it was found that the vehicle had been engaged in criminal activity in Shenandoah County involving the use of stolen credit cards and fraud earlier in the day. The vehicle was taken by the Warren County Sheriff s Office for processing and recovery of evidence and will then be turned over to the owners. Anyone with information in this case is asked to call the Warren County Sheriff s Office at (540) 635-418 or Sergeant Gordon Foster at (540) 635-7100. (From a release)
Two locals arrested during a Larceny in progress

Fauquier County Sheriff s Office deputies responding to a larceny in progress arrested two Front Royal men on Sunday, Sept. 18. The incident was reported when a suspicious vehicle was observed at a building in the 1000 block of John Marshall Highway in Linden, VA. Sgt. Pat Coffey arrived and observed a male subject loading items into a truck while another subject was inside the building. The two subjects were detained by Sgt. Coffey and Sgt. Ray Acors and identified as 31year-old Joseph Louis Ruffo Jr and 3-year-old David Talmadge Curry. Ruffo, of the 600 block of Old Belmont Rd, Front Royal, was charged with possession of marijuana and counts of grand larceny and held on a $500 bond. Curry, of the 00 block of Cloud St, Front Royal, was also charged with possession of marijuana and counts of grand larceny. Curry was released on a $5000 bond. (From a release) 413 A. Company 1 did meet them at the hospital; Despite his firefighting credentials, Krysler himself, was rejected for membership by the SFVFD Board of Directors in an unofficial meeting, even though membership was supposed to be decided by the membership, not by the Board. He added that only two Board of Director members attended this secret meeting; Meetings were not being run by Roberts Rules. In light of the Clarke County Commonwealths Attorneys Office finding it appears where Krylser saw smoke at the Farms fire department there was, indeed, fire. However proving whether that fire was, at least in part, intentionally set remains another matter. (Some info from a release)

Jeff the mailman is a family man, with a wife Teresa; two grown daughters, Kelsey and Jordan; and a couple of grandkids; plus Comet, their 16-year-old beagle mix. He has a beard and like many men with beards, a twinkle in his eye and a ready smile. He was born in Front Royal. Jeff, along with the rest of the family, is a product of Warren County High School (1975) and attended the 30th reunion. His first route was the one hes driving now (seven years to date) but among others he has driven are High Knob, Browntown, and Shenandoah Shores. On all roads in the county, the wildlife provides Jeff with entertainment - from the inevitable deer, to foxes, birds and skunks. During his off hours, hes a stock car racing fan. He has just a couple of worries in his life right now, one the future of the postal service (see Bianchinis article in the last issue of the Report to discover whats going on), and two, reckless drivers who pass his van on blind curves and corners, hills and so on. Im shocked by those who will pass in the most dangerous places, without even slowing down, taking the most dangerous chances, Jeff said. U S Postal Service urges Congress to act now

Legislative flexibility required to deliver, grow successful business model
put the Postal Service on a track to insolvency. The options under our control we have pursued aggressively by slashing our annual operating expenses by more than $1 billion and reducing our size by 110,000 career positions over the past four years, said USPS Northern Virginia District Manager Michael Furey. USPS continues to consolidate mail processing facilities to reduce personnel, energy and transportation costs, and is studying approximately 3,700 retail offices for possible closure. A new strategy, the Village Post Office, provides expanded access. Despite the aggressive efforts to control costs, more is needed to close the projected budget deficits. For us to remain viable, we need Congress to act on legislation that would eliminate the current mandate requiring retiree health benefit pre-payments before the end of September. That mandate costs the Postal Service $5.5 billion annually. Legislation also is needed to return a $6.9 billion overpayment into the Federal Employees Retirement System to the Postal Service. If not for the unique health benefit pre-funding requirement, the Postal Service would have recorded a cumulative profit of $1 billion from 007 to 010, said Furey. USPS is exploring legislative proposals to establish its own health benefits program, administer its own retirement system, and adjust the size of the workforce to match operational needs of the changing marketplace. It also is seeking legislation that will give authority to determine the frequency of mail delivery, which can save the Postal Service roughly $3 billion each year. The Postal Service is not seeking tax subsidies or additional borrowing authority. It receives no tax dollars for operating expenses. Operations are funded through the sale of postage, products and services to fund operations. It is not seeking additional borrowing authority, but does want the ability to access monies previously over-paid into the retirement fund. The Postal Service delivers 167 billion pieces of mail annually to more than 150 million addresses, or more than 40 percent of the worlds mail. The Postal Service remains critical to the economy. We anchor a mailing industry that represents more than 8 million jobs and more than $1 trillion in commercial activity annually, said Furey. The core function of the Postal Service and core need of our customers will always exist. In order for the Postal Service to be put on the road to solvency, Congress must take action to give us the flexibility to operate as a business. We have done our part to control escalating costs. Now it is time for Congress to do its part. We need substantive legislation to transform the Postal Service business model, and we need it now. Virginia Receives Preliminary Approval to Toll I-95

RICHMOND Governor Bob McDonnell has announced that the Federal Highway Administration (FHWA) has granted the Virginia Department of Transportation (VDOT) preliminary approval for his administrations plan to toll I-95 under the Interstate Reconstruction and Rehabilitation Pilot Program. In a Sept. 14 letter, FHWA Administrator Victor Mendez granted the conditional provisional approval and outlined steps required to move forward. As part of this approval, VDOTs conditional provisional approval to toll I-81 will be rescinded, and I-95 will become one of three projects under the Interstate Reconstruction and Rehabilitation Pilot Program. At Governor McDonnells request, Secretary of Transportation Sean T. Connaughton submitted Virginias proposal to FHWA outlining a concept to toll I-95 in April 010, and VDOT submitted a formal expression of interest in January 011. Preliminarily, VDOT estimates it could generate $50 million over the first five years of the toll program and over $50 million annually thereafter. These toll revenues will help fund capacity expansion, operational improvements, safety improvements, and pavement and structure reconstruction and rehabilitation

throughout the corridor. Examples of specific projects that could be funded through toll revenues include widening I95 between I-95 and the North Carolina border, enhancing Intelligent Transportation Systems and installing over-height detectors on bridges, shoulder widening and the installation of guardrails, and improving pavements on more than 700 lane-miles within the corridor. The entire I-95 corridor averages a level of service of D and some more urban portions are F during peak periods, said Secretary Connaughton. This level of service is unacceptable anywhere, let alone on the most traveled corridor in Virginia. The ability to implement tolling will provide the revenues necessary to improve I-95. FHWA Administrator Mendezs letter outlined important steps to be taken by VDOT before full approval is granted. By granting VDOT conditional provisional approval, USDOT is reserving a slot in the Interstate Reconstruction and Rehabilitation Pilot Program. This reservation will allow VDOT to undertake necessary studies. The Interstate Reconstruction and Rehabilitation Pilot Program is a federal demonstration program that provides authority for only three states to toll Interstate facilities. Once the statutory provisions of the program are satisfied, the opportunity for tolling will be available. VDOT will work closely with FHWA to complete the steps outline by Administrator Mendez, as well as any necessary environmental documents, said VDOT Commissioner Greg Whirley. Our goal is to complete these steps as quickly as possible so we can develop and implement a satisfactory toll agreement with the FHWA. Speaking about todays announcement, Governor McDonnell said, I-95 is one of the most important and heavily traveled highway corridors in the country, linking population and commercial centers up and down the East Coast. Limited funds and growing capital and maintenance needs have led to deficient pavements and structures, congestion, higher crash density and safety concerns. This approval is a major step toward funding critical capacity and infrastructure improvements needed in this corridor. The
Commonwealth cannot continue to be a leader in economic development and job creation if we do not address our transportation needs. Earlier this year, the General Assembly passed my transportation plan setting the framework for investing $4 billion in our transportation network over the next three years. The ability to toll I-95 will help leverage this investment by funding transportation improvements in this vital corridor. (From a release)

Town, EDA discuss the future in changing landscape

or redevelop the languishing and dilapidated Afton Inn at one entrance to the historic, downtown East Main Street commercial district. That the future of Front Royal as a viable business location now hinges on reinventing itself commercially in large part due to new county shopping malls enabled by the towns extension of central water and sewer service into the county seems ironic, if not totally unpredicted. But with the deed done and some councilmen still unhappy with unresolved answers to questions about how $700,000 of lost corridor meals tax fee revenue will be replaced the question is no longer why we did it; but rather how do we now survive commercially in the face of a seemingly irreversible commercial and tax revenue move out of town? Part of the discussion revolved around how much specific help the EDA can offer and how can the town reinvent itself to be a viable commercial destination in the future. Part of the answer was resurrecting downtown and all of
Front Royal as a more attractive and vibrant tourist destination with a focus on smaller, independent restaurants, specialty shops and neighborhood commercial centers. We know where we need to be, its just rough getting there, Mayor Tim Darr commented. By Roger Bianchini Warren County Report Just a week after the town-county liaison committee broached the subject delicately Shae Parker reminded his fellow councilmen that the existing policy concerning the extension of town central water and sewer outside town limits into the rest of Warren County, particularly the burgeoning Route 5 North Industrial-Commercial Corridor, is in need of serious revisiting. What we have now is bad policy, and is vague, Parker said at the Sept. 19 council work session. Tom Conkey supported Parkers contention and suggested council needed to give town staff more concrete direction otherwise they are shooting in the dark. Where do we want to go philosophically? Conkey asked. As that policy, dating to 006, currently states, all requests for town central water-sewer will be considered on a case-by-case basis with discussion of whether rezoning or a boundary adjustment is appropriate in order to justify any central utility extension out of town. Proffers to compensate both the town and county for any future development enabled by the extension of town central utilities is also mandated, as is a municipal line in the sand that town taxpayers will not shoulder the burden of utility extension into non-town portions of the county. Perhaps the portion of the policy that is the most vague and upon which future conflict could center is the statement that where rezoning is not part of the request for town utilities the Town may provide water and/or sewer service into the County on a case-by-case basis under the same terms as it has done in the past. From discussion since this 006 policy was approved by council, the county perspective seems to be that the past precedent is that if we ask for it, we get it. Parker and Conkey have been at the point of council discussion that no such precedent can exist without first accounting for future development within town and known extensions that will be going into the county for already approved projects. During the Sept. 19 discussion Mayor Tim Darr appeared to agree with Parker and Conkey that changing circumstances had to be addressed prior to any fu-

ture agreement to extend town water-sewer into the countys north commercial corridor. This has been floating since 006; dynamics have changed since it was written, Darr said. Among the changed dynamics are the pending release within 1 to 18 months of 160 acres for commercial development in town at the Royal Phoenix Business Park; and the already agreed-to extension of out-of-town watersewer to a Dominion-VEPCO electrical generating facility that will require as much as a million gallons of water a day, as well as water-sewer to both the new county Public Safety Building and the regional jail. The Crooked factor Conkey noted that former Town Attorney Tom Robinett had indicated that the towns extension of water-sewer to the Target-anchored portion of the north corridors Crooked Run Shopping Center implied a commitment to additional connections there as needed. However, Conkey suggested that committed future utility extension applied only to portions of the shopping center already approved for county rezoning under the requirements of a request for town water-sewer as described in the water policy. Hollis Tharpe said if the town could run a water line into the county, it followed that we run water too. Conkey countered that the towns first responsibility was to its own. At what point do we determine when it exceeds our ability to extend service to town customers and citizens? Conkey responded to Tharpe. And while the towns recent water system upgrade has increased its capacity to 4-million gallons per day (current use is about .3 million gallons per day) with the potential to add another -million gallons per day with additional upgrades, approved and anticipated in-town and out-oftown development leaves many unanswered questions. Town Manager Steve Burke also pointed out the state has only permitted the town to use up to 4-million gallons per day. Any consequent upgrades could only come if the state authorized the additional use by the town. We get re-permitted, Tharpe stated of increasing capacity to accommodate any coming requests that might push the town system beyond its current state permit level. That begs the question the river has only so much water in it, Conkey said, pointing to variables such as surrounding municipalities use of the river as a water source and the potential return of drought conditions limiting the amount of water

Unresolved crisis The towns loss of a 009 lawsuit brought by three chain corridor restaurants, Applebees, TGIFridays and Cracker Barrel, challenging the attachment of a meals tax-based fee to its water-sewer bills led to the current town-county impasse on how the town should be compensated for the water-sewer it has already extended for that commercial development at Riverton Commons and Crooked Run. The town lost an estimated $600,000 to $800,000 in annual corridor fee revenue as a result of that court decision. A major factor in that decision appeared to be the 00 implementation of a county meals tax that resulted in county corridor restaurants paying a double 8percent meals tax. The tax-based corridor fees were enabled by a 1999 three-judge state court panel approval of the 1998 Corridor Agreement between the town and county. That agreement headed off what would have been a contentious annexation battle had the town not been allowed to recover potential lost tax revenues by allowing county com-

issue for Duncan is the fact that even when the county takes on such additional funding in 1999 it was the airport, animal control and parks and recreation town citizens, who are also county citizens, continued to fund 40 to 50 percent of those functions through their county taxes. Duncan believes that this fundamental double taxation of town citizens for their dual citizenship has never been factored into how the town and its people shoulder the burden of out-oftown development enabled by the extension of town utilities into the county. A head knocker Parker asked that council keep this subject as a matter of monthly discussion. The mayor agreed and no one expressed dissent. However Tharpe also suggested the water policy/5 corridor topic be scheduled for discussion at a coming council retreat. The mayor agreed the topic would take more than the normal amount of time generally allotted for council work session agenda items. This is probably going to take more than two or three hours it is going to be a head knocker, Darr observed. The question remains, which council heads are capable of having any comprehension knocked in, or political self-interest knocked out of them?

Goddard steps back retires from Allstate, resigns HSWC

position as president of the Humane Society of Warren County (HSWC). A former president of the Front Royal Chamber of Commerce, state president of the Veterans of Foreign Wars Auxiliary, vice president of the Business and Professional Womens local organization, and 003 recipient of the Athena Award (sponsored by Buick) recognizing outstanding community service, Carol - a former horse woman - has hung up her spurs, calling it quits at 63. She says she will desperately miss all her clients, many of whom became friends. For the foreseeable future, she says shell do a little traveling and help granddaughter Kayla, 0, establish herself in the pet care business. Hint to husband Charlie Goddard: your wife would like a trip to New England. Carol and Charlie have lived 3 of their 45 years of marriage in the Valley. They live at their Rockland home on Ashby Station Road surrounded by pets: Molly and Gracie, the shelter dogs; and three cats. Their daughter Beth and son Rich live in Front Royal and Strasburg, respectively. Carol looks back fondly on 0 years with Allstate, the first eight in Winchester. Of her years at her office at 36 N. Royal Avenue, her most amusing memory is of her first client. He paid his first six months premium on his car then was hauled off to jail. His insurance stayed in place when his girlfriend picked up on paying the premiums while he served a felony sentence (robbery, or something like that) and he stayed on as a client after he got out. His agent recalls that this item made the late Paul Harveys rest of the story national news radio broadcast. Before leaving, Carol thanked all her clients, and much appreciated the cards, telephone and e-mail messages of congratulations. I was touched (emotionally) by all of them, she said. Horton over past and future payments of disputed proffer fees. On Sept. 6, Judge Designate William H. Ledbetter Jr. ruled that already-made payments of $4,000 per unit for 5 already constructed or approved units was not compelled and so does not have to be reimbursed by the
county to the tune of $08,000. On July 8 Ledbetter ruled that Horton, who purchased residential development rights from original project owner Blue Ridge Shadows LLC., did not have to pay the disputed fee for future construction of the remaining 173 units approved as part of the residential aspect of the threepronged Blue Ridge Shadows project a lost revenue stream of $69,000. In making his ruling on the second aspect of the case, Ledbetter wrote, It would be grasping at straws to come up with an application of some exception to the voluntary payment doctrine
under the circumstances of this case nor was the fee, as Horton asserts, compelled, as that term is used in the cases enunciating the voluntary payment doctrine, for the reasons mentioned above. Those reasons as elaborated by the judge relate to Virginia law that states when someone voluntarily pays an unjust demand,

with full knowledge of the facts, it will not be considered as paid by compulsion and the party thus paying cannot recover back the money paid, even though he may have protested against it at the time he paid it, unless the illegal demand for payment had to be paid to prevent seizure of person or property, or unless there was
some other immediate and urgent necessity for it. Although Horton representatives met with County officials in the spring of 006 and disputed its obligation to pay the fees, and its attorney wrote a letter of protest in September of 006, Horton nevertheless paid the $4,000 fee 5 times in 006, 007, 008, and once in 010, the judge observed. Drawing on precedent at the state level, Judge Ledbetter ruled Virginias voluntary payment doctrine does not cover a desire to develop ones property on a self-imposed schedule. At no time was Hortons property in danger of seizure or of any other proceedings or actions; rather, the County simply maintained the position that it would not issue building permits without the fee, Ledbetter wrote in his Sept. 6 ruling. History The fee of $4,000 was added to an original proffer of $8,000 per unit by the county in lieu of an earlier requirement the original developer build a private central water-sewer treatment plant. Warren County says we have an agreement with Blue Ridge Shadows that if we delete proffer E (construction of the central water-sewer package plant) we are compensated in this amount You cant call it a hook-up fee, theres nothing to hook up to [because the county has no central water-sewer system], Ledbetter observed on July 8. During subsequent negotiations, which the county was excluded from, the Town of Front Royal agreed to allow the development to hook into its central water-sewer system. As reported elsewhere in this issue, that sysNorth Corridor to accommodate residential growth patterns outlined in the countys Comprehensive Development Plan. However based on consultant study and associated costs of developing its own water-sewer system the county eventually abandoned that idea.

Dear Stewart, Whats this talk about a bike gang coming to Front Royal? Pedaled Hi Pedaled, You must have heard about the STIHL Tour Des Trees, a group of bicyclists who are riding to raise funds for tree research. In its 0th running, this years Tour will start on October nd in Virginia Beach. Seven days and 485 miles later, the riders will end their challenge at the National Mall. This event benefits the TREE Fund, which is devoted to tree research and educational endow-
ments. Grants have led to a better understanding of the benefits of trees, the development of hardier plants and methods of protecting trees while using fewer pesticides. Increasing the publics awareness of the importance of trees is a high priority for the Tour. To further this effort, several trees will be planted along the route. Each participant is tasked with raising at least $3500 for the cause. The riders will be coming from points as far as Florida, Ontario, California and British Colombia. A local cyclist who has participated for many years is Tom Armstrong of the Bartlett Tree Expert Company. On Day 5, October 6th, the cadre of tree champions will arrive in Front Royal, completing the grueling leg from Charlottesville via the Skyline Drive. At 9am on October 7th, the group arrives at the Virginia State Arboretum at Blandy Farm. After a public tree planting ceremony, the cyclists will continue on to Reston and, finally, Washington, D.C. As the riders housing and meal expenses are being covered by corporate sponsorship, 100% of all donations to the STIHL Tour des Trees will benefit the TREE Fund.
