X--------------------------X COMPLAINT Plaintiff, through the undersigned counsel and unto this Honorable Court, respectfully alleges that : 1. The plaintiff, is of legal age, Filipino,married, and a resident of 332 Bitano, Legazpi City,hereinafter referred to as the PLAINTIFF while the defendant is likewise of legal age, Filipino, married, and a resident of Taysan, Legazpi City, hereinafter referred to as the DEFENDANT, where she may be served with summons and other court processes; 2. On October 28, 2011 an extrajudicial partition with sale was executed wherein the defendant is a part seller and the defendant is the buyer, copy of said document is hereto attached and marked as Annexes A, A-1 and A-2; 3. Despite said extrajudicial partition with sale, the defendant did not vacate the premises and that several oral and written demands to vacate were made but just the same the said Defendant still refuse to vacate. copies of the written notices are hereto attached and marked as Annexes B, B-1 and B-2; 4. Due to failure of the defendant to vacate the said lot, the plaintiff was compelled to file the instant action and engage the services of the undersigned counsel. WHEREFORE, it is respectfully prayed that judgement be rendered ordering the defendant to vacate the premises and pay the cost of the suit.
