It is known that Banks are very suspect today, with precedent and evidence of fraudulent activity, regarding the practice and procedure around promissory notes, the actual owner of the note, producing the note, as well as volitions of the Truth in Lending Act and Regulation Z. There is enough evidence to strongly suggest that there has been unclean hands, foul play, non-disclosure and illegal banking practices concerning the rightful ownership and interest, as well as the source of the funds to supply purported loan, i.e. alleged lender is making false claims that must be verified and proven as valid and legally enforceable. Evidence will be shown that Plaintiff has a bona fide superior claim of ownership and rightful title as the only signer on the promissory note and Defendant is not a singer on the note, which is an antecedent breach of contract and has no legal standing of interest or right of ownership, nor is a party to the original note or a signer. CONTRACT: An agreement, upon sufficient consideration, to do or not to do a particular thing. A covenant or agreement between two or more persons, with a lawful consideration or cause. {Blacks Law 2nd ed.} Thus the Doctrine of Lis Pendens is called upon to provide the necessary time to conclude the law suit against the purported lender for Motion to Arrest Judgment of the Unlawful Detainer, stop all actions of Defendant against Plaintiff and compensation for profits made on Plaintiffs note.
