5. POLICIES
At ABC INDUSTRIES (PVT) LIMITED, all the policies are made by Managing Director or/and the concerned Directors and are applicable to all the employees working in the company and are implemented company wide at the same time. Any change in these policies are circulated company wide through Human Resource department and if the policy is posted/pasted then the old one is removed and the new is pasted/posted, until unless the new one is placed, the old one is considered valid. Human Resource department keeps all the policies in record and duly signed by the concerned director, until unless a policy is signed with date and company seal it is not considered valid and is not followed in part or in complete by any individual and /or group of employees. In case of any misunderstanding, confusion and ambiguity with relevant to the policy the said employee concerns the Human Resource Manager and gets the clarifications, no other interpretations are accepted, if and otherwise by Human Resource Manager. P.S. All the policies are given in a print out form to the new employees at the time of hiring and all the old employees are kept update with prevailing and upcoming policies.

POLICY -1
Termination of Employment For terminating employment of a permanent workman for any reason other than misconduct, one months notice shall be given either by the employer or the workman. One months wages calculated on the basis of average wages earned by the workman during the last three months shall be paid in lieu of notice.

The periods and hours of work for all classes of workman in each shift shall be exhibited in Urdu and in the principle language of the workman employed in the industrial or commercial establishment on notice boards maintained at or near the main entrance of the establishment and at the time keepers office, if any.

All workmen shall be at work at the establishment at the time fixed and notified under standing order 3. Workmen attending late shall be liable to the deduction provided in the payment of wages Act.

In ABC Industries, The Human Resource department advises Finance department of the name and details of those workers who have been in permanent services for not less than ninety (90) days, and are entitled to receive bonus, if in that fiscal year company shows profit in the final close out financial statement. ** Standing Order 10-C added by the Ord. No. IX of 1972, s.2 & 1st Schedule: Pg 89 Every employer making profit in any year shall pay (for that year within three months of closing of) that year to the workman who have been in the employment in that year for a continuous period of not less than ninety days a bonus in addition to the wages payable to such workman. The amount of bonus payable shall: a. The amount of the profit not less than the aggregate of one months wages of the workman employed, be not less than the amount of thirty percent of such profit; illustration 1 - If the profit is Rs.120,000.00 and the aggregate of one months wages of the workman is Rs, 30,000.00, the amount of bonus shall be not less than the aggregate of one months wages, that is to say Rs. 30,000.00 illustration 2 - If the profit is Rs. 30,000.00 and the aggregate of one months wages of the workman is also Rs. 30,000.00 the amount of the bonus shall not be less than thirty% of the profit that is to say Rs. 9,000.00 b. If the amount of the profit is less than the aggregate referred to in paragraph (a), be not less that fifteen percent of such profit.

In ABC Industries, the Human resource department informs all the workers if any urgent stoppage of work is required in case of fire, catastrophe, break-down of machinery or stoppage of power supply, epidemics, civil commotions etc, if the stoppage is more that one hour then they are paid in accordance with their monthly wages, and in case of piece rated, daily wages workers, the average daily earnings of the previous month shall be taken to be the daily wage.

In ABC Industries, the Human Resource department controls the problem of lay off and all the workers who are laid off due to any reason are paid an amount equal to one-half of their daily wages during the first fourteen days of lay-offs as compensation, but if the lay off goes beyond this time till indefinite period then their services can be terminated with all given incentives.

1 (3) In case where workmen are laid off on account of failure of plant, a temporary curtailment of production or any stoppage work for reasons mentioned in clause (1), they shall be paid by the employer a an amount equal to one-half of their daily wages during the first fourteen days of lay-offs as compensation, but if the lay off goes beyond this time till indefinite period then their services may be terminated after giving them due notice or pay in lieu thereof.

In ABC industries, the Human Resource department controls the matter of gratuity for all those who leave the company on their accord, terminated, dies, etc, and the payment of gratuity is made equivalent to thirty(30) days per year of the service multiplied by the number of the years in service with the company.
(6) Where a workman resigns from the service or his services are terminated by the employer, for any reason other than misconduct, he shall be paid gratuity equivalent to thirty days wages calculated on the basis of the 2 wages admissible to him in the last month of service if he is a fix rated workman or the highest pay drawn by him during the last twelve months if he is a piece rated workman] for every completed year of service or any part there of in excess of six months:

In ABC Industries, The Human Resource Department controls the Provident fund matters of the workers who resign, or terminated other than any misconduct, The total of 8.33% of the gross salary is deducted as Provident fund on monthly basis and the matching amount is provided by the Company and paid to the worker with final settlement of the dues.
A workman shall be entitled to receive the amount standing to his credit in the provident fund, including the contribution of the employer to such fund, even if he resigns or his dismissed from service.

The pubic, Government holidays are exercised with full pay in accordance with the Govt. announcement.
Workman in an establishment is allowed to take 14 days annual holidays with pay, 10 days casual leave with pay, 16 days sick leave on half pay and all the festival holidays with pay declared by the federal or provincial govt.

MEDICAL BENEFITS
In ABC industries, the Human resource department takes care of Medical benefits of all employees. All permanent employees are insured against hospitalization for any disease and accidental disability worth Rs. 50,000/- for the time as per (three in a 12 months cycle. For general diseases 10% of the Gross monthly salary is given to every permanent employee in 30 days cycle.

** (1) The employer shall have all the permanent workman employed by him insured against (disability and injury arising out of contingencies not covered by the workmans compension Act, 1923 (VIII of 1923), or the provincial employees social security ordinance) 1965. (2) The employer shall in all cases be responsible for the payment of the amount of premia and for all administration arrangements whether carried out by him self or through an insurance company.

PERMANENT EMPLOYEE
In ABC industries, the Human resource department, tracks the permanent employees record and their employment period is kept under vigilance through personal file. All the employees who have completed more then (9) months and has satisfactorily completed the probationary period of three month permanents employees.

** A permanent workman is a workman who has been engaged on work of permanent nature likely to last more than none months and has satisfactorily completed the probationary period of three months in the same or another occupation, in the industrial or commercial establishment, including breaks due to sickness, accident, leave, lock out, strike (not being an illegal luck out on strike).

PROBATIONARY EMPLOYEES
In ABC industries, the Human resource department keeps the track of those who are on probation, and have been hired to fill a permanent post. They are entitled to all teams, sick, casual etc. without any pay, but the days of the hearer are included in their three months period.

WOMEN WORKERS
In ABC Industries, the Human Resource department strictly follows the given rules and regulations in terms of hiring women Workers: 1. All the women workers are hired as per companys hiring policy for individuals/groups. 2. Women workers are not placed on the floors, not attended by any senior supervisor, Manager or senior staff member. 3. Women workers are not placed in the night shifts working in any case. 4. Women workers follow the daytime shift, the general working shift.

5. Women workers are entitled to have Maternity leave of 40 days with pay, in case of permanent employment. 6. Women workers on permanent employment are entitled to all benefits as per male workers.
