CONDITIONS REGARDING RESERVATIONS Transat Tours Canada Inc. doing business as Air Transat ("AIR TRANSAT") and as a travel agent, acting as an intermediary between you and the carriers, the hotels, and other service providers (the "Providers"). The purchase of travel services (hereinafter referred to as the "Services") offered by AIR TRANSAT on this site, constitutes a contractual agreement between you and AIR TRANSAT and implies your acceptance of AIR TRANSAT'S Conditions regarding Reservations described below. Please ensure you read carefully and understand these Conditions prior to booking.

1. DESCRIPTION OF THIS WEBSITE AIR TRANSAT has put forth all necessary efforts to ensure that all descriptions contained on this site are up to date. This system is updated on a regular and continuous basis. For several reasons beyond the control of AIR TRANSAT, modifications can take place which may affect descriptions found on this site. AIR TRANSAT will not be held liable for any of these modifications. Photographs or pictures appearing on this site should be used solely as an indication and shall not be construed as part of these Conditions. You are advised to make your selection according to price, location and services offered. Decor and furnishings may vary from room to room, in accordance with the individual location on the hotel premises.

2. PRICES AND RESTRICTIONS

Prices are quoted in Canadian dollars (CAN$), unless otherwise indicated, and are calculated per person. All services purchased on this site are non-refundable, nontransferable, and cannot be changed or cancelled, unless indicated otherwise. Penalties or change fees imposed by the supplier will be your responsibility. Some airline tickets are issued at a special rate that carries restrictions and do not permit cancellations, reservation changes or reimbursement of the total amount paid. Prices indicated are subject to change and AIR TRANSAT reserves the right to correct any error regarding an advertised price, before your departure, and without any further notice. No price increases are permitted after you have paid in full. No discount or refund will be provided should the sale price of your product(s) decrease following your purchase. The price does not include the land portion unless indicated otherwise on your invoice. If you are a Quebec resident, an amount of $2 ($3.50 for purchases before April 1, 2012) per $1000 of travel services purchased is added to your invoice for your contribution to the Indemnity Fund. AIR TRANSAT reserves the right to cancel a reservation without further notice, due to non-payment or due to litigation regarding payment. The name and phone number of the person contacted in cases of non-payment is found on the first page of the invoice.

3. RESERVATION AND CONFIRMATION

Reservations are strictly personal and must be accompanied by a payment in full before they can be considered confirmed. At the time of reservation of certain flights to the United States, the Caribbean, or to Europe, you may be requested to provide certain information found in your passport. Confirmation regarding price, travel dates, flights, hotels, car rentals, and other services, is given once the payment is received and based on availability.

4. PAYMENT BY CREDIT CARD Upon reserving Services, you acknowledge and accept that AIR TRANSAT may apply your credit card, without your signature, towards the payment of your invoice. 5. TRAVEL DOCUMENTS A Canadian passport is required for all travel outside of Canada and is the only reliable and universally accepted evidence of Canadian citizenship. Certain countries require that the passport be valid for six (6) months beyond the date of return to Canada, or require a visa for Canadian citizens or those born in another country. Some countries may not allow entry to visitors carrying the passport of certain other countries. Please consult the "CHILDREN" section below if a child under the age of 18 is travelling alone or with one parent only. You should contact the nearest foreign government office of the country you plan to visit for definitive, up-to-date information on travel documents, such as passports, visas, affidavits or notarized letters of consent, that are required by each person for whom you are purchasing travel. Countryspecific and interactive passenger-specific information is also available at www.iatatravelcentre.com and www.voyage.gc.ca. We could provide you with additional assistance but this is not a substitute for contacting the relevant foreign government office. Failure to provide the required documents may result in denied boarding privileges by the carrier or the relevant authorities, without recourse or refund. Your entry may also be refused even if documentation is complete. A previous criminal record could result in denied entry into the U.S. or internationally. No trip refund or replacement will be given for inadequate, lost or stolen documents or for any denied entry. AIR TRANSAT cannot be held liable for any damages resulting from failure to obtain travel documents, to comply with applicable laws, for delay in document delivery, or for any aid or information given by its agents or employees. Living standards and practices in other countries, and the standards and conditions there with respect to the provision of utilities, services and accommodations, may differ greatly from those found in Canada. Medical inoculations may be recommended for the countries or regions you will be visiting.

6. CHILDREN If a minor (i.e. under 18) is travelling with only one parent, either (i) the absent parent must provide notarized consent or (ii) the travelling parent must provide proof of sole custody or a notarized letter that the other parent is deceased, as the case may be. All notarized consent letters should indicate the destination and length of travel, as well as consent to provide emergency medical treatment if required. If a minor is travelling alone or is accompanied by an adult other than a parent, both parents (or the sole documented custodial parent) must provide notarized consent. If a minor travelling alone has only one parent as evidenced by his/her birth certificate, a notarized copy of the birth certificate or the original, together with the notarized consent of the parent, will be sufficient proof allowing for travel. You should contact the nearest foreign government office of the country you plan to visit for definitive, up-to-date information on these requirements and others, such as document translation requirements.

7. FLIGHTS AND CARRIERS Flights offered by AIR TRANSAT are conducted in accordance with the applicable tariff of the air carrier and pursuant to regulations set out by the Canadian Transportation Agency. All such flights and rates are also subject to approval by the relevant government authorities. Consolidations and changes in the published schedule, aircraft type, days of operation, air carrier providing air transportation, and flight itinerary may be undertaken at any time and without prior notice, in accordance with the air carrier's tariff. Schedule Check and Connecting Flights: Flight schedules are subject to change without notice. You are entirely responsible for verifying your flight schedule with the air carrier during the 24-hour period immediately prior to the departure and the return date. You must reconfirm your return flight within 24 to 72 hours prior to the scheduled take-off time. AIR TRANSAT undertakes to notify customers reasonably in advance through means it deems appropriate of any schedule changes resulting in the advancement or delay of the flight departure times or in case of cancellation of a flight. Whenever you book connecting flights, you have the responsibility to allow yourselves sufficient time to make the connection. No control can be exercised over air carriers to guarantee flight schedules, which may be altered or affected by various circumstances. AIR TRANSAT will not be liable for any change of schedule or a missed flight connection, including any additional fees incurred and special, incidental or consequential damages (including the carriage of baggage) arising from the foregoing, whether or not it had the knowledge that such additional fees or damages might be incurred. Airport check-in: It is recommended that you arrive at the airport check-in counter at least three (3) hours prior to departure, failing which your reservation may be cancelled and your seats assigned to other customers, with no right of recourse.

Seat assignment: Unless already pre-assigned, aircraft seating is conducted by staff at the air carrier's check-in counter. Other applicable conditions: Air transportation is subject to all applicable government regulations and is governed by the Montreal Convention, or the Warsaw Convention as the case may be, the applicable tariffs of the air carrier as well as the conditions of contract appearing on the airline ticket. Once filed with and approved by federal regulatory authorities, any amendments or changes to the applicable air carrier's general terms and conditions of carriage are not subject to additional public notice and are legally binding. Refusal to transport ' Removal of passengers: AIR TRANSAT shall not be liable for either refusal by the air carrier to transport a passenger or for the cancellation of a reserved space or removal of a passenger from an outbound flight and/or return flight due to, but not limited to, failure to present himself/herself for an outbound flight (no show), safety reasons to prevent the violation of any applicable laws of any country or to prevent any hazard or risk to such passenger, to any other person or property, or to the flight.

8. VALIDITY OF TICKETS Tickets are non-refundable and non-transferable. However, the value of the ticket could be used towards a change in dates for a change madefourty-five (45) days before the date of departure of the originating flight. Rules and restrictions are set by the air carriers and are subject to change. Certain modifications regarding your reservations may result in additional charges.

9. CANCELLATION AND MODIFICATION CHARGES For all cancellations and modifications regarding any cause, the following charges apply: Cancellation: Cancellations made forty-four (44) days or less prior to the date of departure are one hundred percent (100%) non-refundable. Cancellations made between forty-five (45) days and sixty (60) days prior to departure are fifty percent (50 %) non-refundable. Cancellations made as of the sixty first (61st) day are fifteen percent (15 %) non-refundable, or three hundred dollars (300.00$) per person for packages.

Modification: Modifications made forty-five (45) days or more prior to departure: one hundred and fifty dollars (150.00 $) charge per person plus the new price difference. Modifications made within forty four (44) days: no changes permitted. One hundred (100 %) non-refundable.

10. BAGGAGE Limits: Air carriers have individual rules and regulations with respect to baggage weight, size and number. You must consult with them for applicable restrictions. Liability: The provisions of the Montreal Convention, or the Warsaw Convention, as the case may be, the applicable tariffs of the air carrier, as well as the notice appearing on the passenger ticket and baggage check, govern the loss of and damage to baggage and establish the limits of the air carrier's liability. Passengers' baggage and property are transported, stored and handled at owner's risk at all times.

11. TRAVEL INSURANCE For each reservation, AIR TRANSAT offers you and your travel companions the option of taking out an insurance policy to protect you and your travel companions against certain events ' which may include but are not limited to coverage for trip cancellation or interruption, out of country medical, travel accident, baggage, personal effects, personal money, travel delay, etc. ' that may occur before, during or after (for a specified number of weeks) your trip. You hereby acknowledge that AIR TRANSAT made this offer of insurance in good faith and that you have made an informed decision to take out or refuse such insurance and to assume full liability for your decision.

12. CUSTOMER ADVISORY Some events are part of normal unpleasant occurrences which can happen when travelling abroad. You realize this, you solely assume the consequences thereof and you agree that AIR TRANSAT cannot be held responsible for any damages owing to such occurrences. Living Standards: Living standards, religion, local practices and the political system at the destination, and the conditions there with respect to the provision of utilities, services and accommodation, may differ from those found in Canada. Service disruptions: Some services including water, electricity, air-conditioning, security, sanitary conditions, pools, restaurants and other services or benefits may be suspended or interrupted partially or completely during your stay. Food, water and beverages: The food, water and beverages may not be up to North American standards. Insects: Insect life thrives in certain climates and makes no distinction between budget, intermediate or higher-priced hotel accommodations. Construction: To maintain the quality of services, hotel complexes must regularly undergo maintenance, improvement and renovation work and, in some instances,

Whenever construction or renovation work that is likely to interfere with the use and enjoyment of any accommodation is brought to the attention of AIR TRANSAT, every reasonable effort will be deployed to promptly notify you, however it cannot be held accountable for any inconvenience caused to you. Holidays, school breaks, elections and conventions: Certain inconveniences, such as cancellation or unavailability of some services, when travelling during periods designated as school breaks, other holidays, elections or conventions, may occur. Because these periods vary according to country and relevant authorities, it is practically impossible for AIR TRANSAT to provide any indication of such dates.

13. ROOM ALLOCATION Hoteliers are solely responsible for room allocation, in accordance with the category reserved by you. Should you choose to alter your room category upon arrival at destination (upon availability), you must make your own arrangements with the hotelier and assume all additional fees levied by them. Special requests concerning bed types, room amenities and location can be forwarded to the hotelier, but they do not constitute on any account a confirmation.

14. CHANGES TO YOUR RESERVATION If confirmed Services are no longer available prior to your departure date or subsequent to your arrival at destination, AIR TRANSAT reserves the right to substitute them for comparable alternate Services, or, alternatively, to cancel them. If the substituted Services are of lesser value, the liability of AIR TRANSAT shall be limited to the sole difference in cost. If the substituted Services are of greater value, you will be required to disburse an amount equal to the difference between the price of the Services purchased and that of the substituted Services. You will be entitled to refuse such substitutions. In such a case, and in the event of a cancellation, the liability of AIR TRANSAT shall be limited to the reimbursement of the price of Services paid by you.

15. CUSTOMER RESPONSIBILITY Health: If your physical condition so requires, you must ensure that you have a sufficient quantity of any required medication with you, and that you must carry such medication in your hand baggage at all times. You must also consult competent medical authorities prior to departure about preventive medical measures to be taken with you as regards to the countries to be visited. Pregnancy: A medical certificate establishing the due date and fitness to travel is required. The air carrier may refuse pregnant passengers for whom air travel may involve a risk to themselves or their unborn children. A medical certificate establishing the due date and fitness to travel may be required prior to departure. Please consult the section For travellers of our website in this regard.

16. PRIVACY Unless otherwise advised by you, you consent to receiving personalized special offers on our products and those of the Transat family. We may share your profile and travel preferences only with other companies and members of Transat and to Providers specializing in data processing in order to contact you, via any and all means, with respect to our Services. To opt-out, call our Call Center at 1-866-847-1112. 17. EXCLUSION OF LIABILITY AIR TRANSAT makes arrangements between you and the air carriers, hotels, travel organizers, tour operators, and other independent parties ("Providers") to provide you with the Services you purchase. Although AIR TRANSAT takes great care in selecting its Providers, it does not have any control over them and cannot be held responsible for their omissions, fault or negligence, or that of their employees, nor for any loss or damages suffered as a result thereof. Services provided are subject to the conditions imposed by the Providers and their liability is limited by their tariffs, conditions of carriage, tickets, vouchers, international conventions and agreements.

18. CUSTOMERS REQUIRING SPECIAL ASSISTANCE If you require emergency assistance, please contact our Call Center at 1-866-847-1112 for calls within Canada / United States or at the following number 514-987-7487 for calls outside of North America (local call, long distance). If you require special care, assistance, attention or treatment, you must advise AIR TRANSAT of any and all specific needs at the time of booking, in order to arrange these special services.

19. LAWS This agreement is governed by the laws of the province in which the Canadian gateway city is located. The voiding of one or other of the clauses hereto shall neither annul nor invalidate this agreement. BY RESERVING TRAVEL SERVICES, YOU ARE DEEMED TO HAVE READ, UNDERSTOOD, AND ACCEPTED THE ABOVE CONDITIONS REGARDING YOUR RESERVATION.

20. ADVANCE SEAT SELECTION If you are travelling with Air Transat or on flight operated by Thomas Cook and you Pre-assigned seating, the following conditions apply to your reservation

Passengers with a medical condition are advised to contact our Information and Seat Selection Centre at 1-877-872-6728 to request assistance if required, and the appropriate seat, subject to availability.

For safety reasons, passengers travelling with infants must contact the Information and Seat Selection Center for their selection as they can occupy only certain seats. Passengers occupying emergency exit row seats must be fit and able bodied, willing to assist, must have no reduced mobility, must not be pregnant, must be aged 16 or older, and must be fluent in English and/or French. Seat requests may be altered at check-in or on board if passengers do not meet these criteria. If you or members of your party have to be moved because you do not meet the stated standard safety criteria, you will not be offered a refund. You can make free changes to your advance seat selection without penalty up to 2 days before departure (3 days for departures from Europe), by using your file Reference Number. Air Transat does not issue a refund if you cancel your advance seat selection prior to your departure.

Subject to operational requirements, it may be necessary to change the aircraft type operating your flight. Should this occur, we will try to match your seat request on the substituted aircraft. This, however, cannot be guaranteed. Air Transat will then assign you an equivalent seat. If we cannot assign you an equivalent seat, we will contact you to ask about your seating preferences. In the event that we are unable to assign you an equivalent seat, you may be entitled to a refund. In such a case, you must submit your request for a refund with a copy of your boarding pass along with your contact information within 30 days following the return date of your flight in order to proceed with your request. Any request submitted after that period or without this information will not be considered. Air Transat's liability is limited to refunding the charges incurred for advance seat selection.

Your advance seat selection will be held for you until 1 hour before departure. After that time, advance seat selection can be cancelled without refund. Advance seat selection fees are transferable should you change your flight.
