On Sunday. May 27th. 2012.

I Marine Enforcement Officer Rick Martin overheard a radio call from Central Dispatch (CO), concerning a person that was injured and bleeding uncontrollably at the Ute Lake Marina. I contacted CD and advised them I was in route to the marina from the park visitor center. Upon arrival to the marina Park Manager James Gurule. Park Superintendant Rodney Paris and I searched the area for the victim. and made no contact. A short time later. Paris found that the victim was located at the McFarland boat dock approximately one half mile north of the marina. Upon arrival to the McFarland boat dock I saw a group of people huddled around a person that was lying on their back at the far north end of the dock. This person was later known as the victim Shaina Pool. Paris. Gurule. Park Technician/EMT Rex Stall and I made contact with Pool on the dock. Pool was being assisted by a person later known as LPN Kristy Tivis. It was determined that Pool was breathing but incoherent and had sustained a severe injury to her head and left chest area. At this time Stall made contact with CD. by radio and requested a Medivac be dispatched to the area. A short time later Emergency Medical Services (EMS) arrived and Pool was taken by ambulance to be met by Medivac in Logan. Pool was transported by helicopter to Northwest Texas Hospital in Amarillo. Texas. where it was determined that she had sustained a severe injury to the left temple area of her head. obtained a collapsed lung. and was in a coma. I then made contact with Spencer Norris. the operator of the boat. and asked him what had happened. Norris told me that he and some friends were cruising in the boat on the lake in the Ute Creek area and he thought the boat was traveling at about ten miles per hour and Pool was sitting in the back area of the boat. Norris then told me that he made a right tum heard a splash in the water and felt the boat rise up out of the water. Norris then told me that he heard people screaming and that someone was floating in the water behind the boat. Norris then said that he turned the boat around and passenger Jonathon Mars jumped out of the boat into the water and retrieved Pool. At this time I asked Mars what had happened. Mars said that he was sitting in the front of the boat and he felt the boat make a right tum and then heard people saying that someone was in the water. Mars then said that he jumped into the water grabbed Pools head and lifted it up out of the water. with the assistance of the other passengers Mars was able to get Pool back into the boat. Mars then said he and another passenger. Alexandria Bonestroo. preformed CPR and mouth to mouth breathing on Pool and placed a tourniquet on her arm until they got to the dock. It was determined later. through other passenger witness statements. specifically Madison Stewart and Tre Orozio. that Pool was up at the front of the boat dancing. the boat turned and Pool fell into the water and went under the boat resulting in being striked by the prop. At this time Paris asked Norris if he had consumed any alcoholic beverages. Norris said that he had "a couple beers." After determining that alcohol and contributing to under age drinking was involved. Paris contacted the local District Attorney and the New Mexico State Police for their assistance. Through the direction of the District Attorney. and after the deprivation period. Paris preformed the Standardized Field Sobriety test on the boat operator Norris and it was determined that Norris was not impaired.

By the request of the New Mexico State Police I then transported three of the nine boats occupants to the Ute Lake Visitors Center for further investigation. At this time I cited Norris for Prohibited Operations. for allowing Pool to stand at the bow of the boat while underway. Also. I asked Paris for a Boating Inquiry to be done. According to the inquiry information on the boats Certificate of Number (registration card), the capacity of the boat is six (6). I cited Norris for Prohibited Operations-Overloading. Upon further investigation and reviewing photographs of the boat capacity plate. the plate shows it to allow up to thirteen (13) people. The Prohibited Operations-Overloading citation will be dismissed upon filing into the courts system. Norris also told me that he has not taken any required boating safety course to operate a boat. Thus. Mr. Norris was cited for lack of required Boating Education. Based on my knowledge. training and experience. I believe that Pool fell off the bow of the boat due to her position and standing on the boat while the boat was underway. and operator making a turn to the starboard side. The contributing of alcohol to minors is under the investigation by the New Mexico State Police. No other information at this time. please reference attached supplement reports.
