Philipp8ine clean water act of 2004 DECLARATION OF POLICY State shall pursue a policy of economic growth in a manner consistent with the protection, preservation and revival of the quality of our fresh, brackish and marine waters. How done: 1. Streamline processes and procedures in prevention, control and abatement of pollution 2. Promote envi strategies, use of appropriate economic instruments and of control mechanisms 3. Formulate holistic national program of water quality management 4. Formulate integrated water quality mgt framework 5. IEC 6. System of accountability COVERAGE OF THE ACT Applies to water quality management in ALL WATER BODIES; abatement and control of pollution from land based sources

CHAPTER 2: WATER QUALITY MANAGEMENT SYSTEM 1. WATER QUALITY MANAGMEENT AREA DENR, in coordination with National water resources board, shall designate areas as water quality mgt areas using appropriate physiographic units such as watershed, river basins or water resources regions. Governed by governing board composed of: 1. Reps of mayors 2. Reps of governors of member LGUs 3. Reps of national govt agencies 4. Duly registered NGO 5. Water utility sector 6. Business sector 7. DENR repchairman What governing board must do: 1. Formulate strategies to coordinate policies for implementation of this act 2. Each mgt area shall create a multi-sectoral group to establish water quality surveillance and monitoring network 3. Technical secretariat (at least 4 members) a. Member of Philippine bar b. Chem. Engineer, chemist, sanitary engineer, envi engineer or ecologist c. Civil engineer, hydrologist or has significant training on groundwater d. Geologist, biologist NOTE: Areas within jurisdiction of LLDA shall be designated as one mgt area under the admin of LLDA. 2. MANAGEMENT OF NON-ATTAINMENT AREA DENR shall designate water bodies or portions thereof, where specific pollutants from either natural or manmade source have already exceeded water quality guidelines NON-ATTAINMENT AREAS for the exceeded pollutants Duty: prepare program that will not allow new sources of exceeded water pollutant in NAA without reduction in discharge from existing sources

NATIONAL SEWERAGE AND SEPTAGE MANAGEMENT PROGRAM WHO shall prepare: DPWH in coordination with 1. DENR 2. LGU 3. Other concerned agencies When: in no case exceeding 12 months from effectivity of RA 9275. Program includes: 1. Priority list of sewerage and sepate and combined sewerage-septage projects for LGUs based on: a. Population density & growth b. Degradation of water resources c. Topography d. Geology e. Vegetation f. Programs for rehab of existing facilities g. Other factors Sec. of DENR may deem relevant 2. LGU appropriate the land including required rights of way/road access to land for construction of sewage treatment facilities 3. LGU raise funds to subsidize expenses for operation/maintenance of sewerage treatment facility A DOMESTIC SEWAGE COLLECTION, TREATMENT AND DISPOSAL Within 5 years from effectivity of this act, agency vested to provided water supply and sewerage facitlities in MM and HUCs are required to connect existing sewage line in all subdivisions, condo, etc. to available sewerage system. (subject to service charges/fees) In areas not HUCs, DPWH with DENR, DOH employ septage or combined sewerage-septage management system. DOH formulates guidelines for collection, treatment, disposal of sewage and its operation

NATIONAL WATER QUALITY MANAGEMENT FUND Admnistered by DENR; this is to finance: a. Clean up operations b. Restoration of ecosystems and rehab c. Research, enforcement, monitoring d. Technical assistance e. Grant rewards/incentives f. IEC g. Prevention, control, abatement Includes the ff:

BUISNESS AND INDUSTRY ROLE IN ENVI MANAGMEENT DENR and LGUs in consultation with commerce/business sector formulate incentives for adoption of procedures that will protect water bodies through innovative equipment LINKAGE MECHANISM DENR with LLDA coordinates with the following: a. PHILIPPINE COAST GUARD enforcement of water quality standards in marine waters and offshore sources b. DPWH with MWSS, LWUA, urban water facilities efficient and safe collection, treatment and disposal of sewage c. DEPARTMENT OF AGRICULTURE formulation of guidelines for the re-use of wastewater for irrigation, other agricultural uses and for prevention, control, abatement of pollution from agri activities d. BFAR responsible for prevention/conrol of water pollution and conservation of fisheries and aquatic resources e. DEPARTEMENT OF HEALTH promulgation, revision, enforcement of drinking water quality standards; f. DEPARTMENT OF SCIENCE AND TECHNOLOGY program for evaluation, verification, development and public dissemination of pollution prevention and cleaner production technologies g. DEPARTMENT OF EDUCATION, CHED, DILG, PIA assist and coordinate with DENR in preparation and implementation of comprehensive program pursuant to RA 9275 RECORD KEEPING, AUTHORITY TO ENTER PREMISES, ACCESS TO DOCUMENTS POLLUTION RESEARCH AND DEVELOPMENT PROGRAMS DEN, in coordination with DOST, other concerned agencies and academic research institutions shall establish a national research and development program for prevention/control of water pollution Promote coordination/acceleration of researchetc.

AREA WATER QUALITY MANAGEMENT FUND For maintenance/upkeep of water bodies in WQMA Utilized for the grant of rewards and incentives for those whose effluent discharges are better than water quality, Loans for acquisitions, Repairs of facitilies and Maintenance Amount not more than 10% of the fund operational expenses of governing board WATER QUALITY VARIANCE FOR GEOTHERMAL OIL AND GAS EXPLORATION DENR may provide for variance on water quality criteria and standards CATEGORIES OF INDUSTRY SECTORwithin 24mos and every 2 years thereafter list of categories of industry sector is revised and published.

ARTICLE 2: WATER POLLUTION PERMITS AND CHARGES 1. WASTEWATER CHARGE SYSTEM Done through collection of wastewater charges and fees; considers factors (inducement for polluters to invest in pollution control technology, cost of administering water quality mgt, reflect damages cased on envi, type of pollutant, classification of receiving water body) Based on net waste load; if within standards minimal amount lang 2. DISCHARGE PERMITS requiring owners/operators that discharge REGULATED EFFLUENTS to secure a PERMIT TO DISCHARGE; legal authorization to discharge wastewater ARTICLE 3: FINANCIAL LIABILITY MECHANISM 1. FINANCIAL LIABILITY FOR ENVIRONMENTAL REHABILITIATION Putting up of Environmental Guarantee Fund to finance maintenance of health of ecosystems, conservation of watersheds and aquifers 2. CLEAN UP OPERATIONS Polluters responsible to CONTAIN, REMOVE, CLEAN UP ANY POLLUTION AT HIS OWN EXPENSE. but if he fails to do this, DENR shall be the one to conduct clean up operations and has right to reimbursement. 3. PROGRAMMATIC ENVIRONMENTAL IMPACT ASSESSMENT series of similar projects or components of projects CHAPTER 3: INSTITUTIONAL MECHANISM 1. LEAD AGENCYDENR is the primary govt agency responsible for the implementation of this act 2. ROLE OF LOCAL GOVERNMENT UNITS a.
